 Command was Given to the Sherr of Somersett County that he should take ye

Alexander Carlyle Late of Somersett County Gentl: if he should be found in his Baliwick
                               and him should Safe Keep so that he might have his Body body before the
       Justices of his Lordships County Court of Somersett to be held at Dividing Creek ^the^ third tuesday of
       June then next to answer unto John Banister of a plea of trespass upon the Case &c and that
       thereof he should not fail &c
          And the said John Banister by Levin Gale his attorney declared against the said Alexander
       Carlyle in the plea afd as followeth viz.t                                 Somersett County fs Alexander
       Carlyle Late of Somersett County Gentl: was attached to answer unto john Banister of a plea
       of trespass upon the Case &c
                      And whereupon the same John by Levin Gale his attorney Complaines that Whereas
       the afd Alexander the tenth day of June one thousand seven hundred & twenty at the County afd
       within the Jurisdiction of this Court was Indebted unto the same John in the sum of twenty
       two hundred and forty six pounds of good sound merchantable Tobacco for the Like Sum received
       for the use of the same John and so thereof being Indebted the same Alexander in Consideration
       thereof afterwards that is to say the day afd in the year afd at the County afd within the afd Jurisdiction
       upon himselfe assumed and to the same John then and there faithfully promised
       that he when afterwards he should be thereunto requested the afd sum of twenty two hundred and
       forty six pounds of tobacco to the same John the would well and faithfully pay and Content
           Nevertheless the afd Alexander altho' he then and there that is to say the afd tenth day of June in the
       year afd at Somerset County afd within the Jurisdiction afd fourteen hundred & twenty five pounds
       of tobacco part of the afd ^twenty^ two hundred and forty six pounds of tobacco to the said John hath paid
       and Contented yett ye said Alexander as to seven hundred and fifty one pounds of tobacco the
       Residue of the afd twenty two hundred and forty six pounds of tobacco his promise and assumption
       afd in form afd made Little regarding but plotting and fraudulently Intending the same
       John of the afd seven hundred and fifty one pounds of tobacco according to his promise and
       assumption afd he hath not paid or the same John for it in anywise Contented altho' the tenth
       day of June ann Dom one thousand seven hundred and twenty three at the County afd within the
       Jurisdiction afd by the same John Banister he was Requested but the same Alexander the afd
       sum of seven hundred and fifty one pounds of tobacco the residue as afd hitherto to the same
       John to pay or fer him it in any wise to Content hath altogether Refused and still doth
       Refuse whereby the same John says he is the worse and hath damage to the value of fifteen
       hundred pounds of tobacco and thereupon he brings his suite &c    L: Gale P Quer pledg & Jno Doe
