Court of Somersett on the twenty second day of November in the sixth year of our Dominion &c ann Dom one thousand seven hundred and twenty one before the Worshipfull Charles Ballard Gentl: and his associates Justices of our said Court at Dividing Creek and by Consideration of our said Court Recovered against a Certain William West of Somersett parish in Somersett County Gentl: as well the sum of five pounds twelve Shillings Curr.t money of Maryland a Certain Debt as also the sum of three hundred and forty two pounds of Tobacco Costs of Suite whereof he is Convict as also the Record & process thereof in our said Court remaining manifestly appears and for as much as Execution Remaineth thereupon as yett to be done and because we will that those things which in Our Said Court are Rightly done and acknowledged should be Brought to a due Execution Command given that by Good & Lawfull men of your Bailywick you make Known unto the said William West that he be and appear before the Justices of our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of June next to shew Caus if any thing for himselfe he hath or Knoweth to say why the said Edward North should not have his Execution ag.t him the said William West for the Judgm.t afd according to the acknowledgm.t and form of the recovery afd he ought not to have if to him it shall seem mete and have you then & there the Names of those by whom you make the same Known and this writt Witness Charles Ballard Gentl: Chief Justice of our said Court the 29th day of march in the 9.th year of our Dominion &c Ann Dom 1723 (G Dashiell) Thomas Hayward Clk Att which said third tuesday of June to witt the Sixteenth day of the same month ann Dom one thousand seven hundred and twenty four being the day of the return of the said Writt Cometh the Sherr said Edward North by his attorney afd and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorst viz.t By vertue of the within Writt to me directed to the Justices within Mentioned I humbly Certifie that I have made Known unto the said William West that he be & appear at ye time place within Contained bef to shew Caus if any why Exn should not Issue against him for the Debt & Costs within Contained before Hugh Porter & Jno Doe good & Lawfull men of my Bailywick as by the within Writt I am Commanded to answers Jos: MccClester Sher Whereupon the said Edward North by his attorney afd prays that the said William West to his writt of Scire facias afd may answer but the said William West altho' solemnly Called Came not but makes default nor shew Cause why &c but makes default whereby the said plft remains against the said deft thereof undefended &c Therefore it is Considered by the Justices here the sixteenth day of June ann Dom one thousand seven hundred & twenty four afd that the Said Edward North have his Execution against the said the William West for as well the sum of five pounds twelve shillings ^Currt money of Maryland^ this debt afd as also the sum of three hundred & forty two pounds of tobacco Costs of Suite in the Judgmt afd specified 252 as also the sum of Two hundred & fifty two pounds of tobacco by the Court here adjudged unto him for his Costs and Damages sustained by occasion of Delay of Execution of the Judgmt afd &c |
