Render unto her three pounds fifteen shillings and one penny three farthings Curr.t money of Maryland & twenty three Bushells of Indian Corn which to her he owes and unjustly detains &c And whereupon the same Mary by Francis Allen her attorney saith that Whereas the said Aaron the twenty sixth day of august one thousand seven hundred and twenty three at the parish and County afd within the Jurisdiction of this Court by his Certain Bill obligatory which the said Mary with the seall of the said Aaron signed here into Court Brings the date whereof is the same day and year did bind himselfe his heirs Ex.rs and adm.rs to pay or Cause to be paid unto the said Mary the afd three pounds fifteen shillings and one penny three farthings and twenty three Bushells of Indian Corn when he should be thereunto required yett the said Aaron tho' often required the afd three pounds fifteen shilling and one penny three farthings and twenty three Bushells of Indian Corn unto the said Mary hath not Rendered but the same to her hitherto to render hath denyed and still doth deny and unjustly detain whereupon the said Mary saith she is worse & hath damage to the value of teen pounds Curr.t money of Maryland and thereof she Brings suite &c F Allen P Quer Pledgd deft Jno Do Richd Roe Whereupon the said Aaron Jorden being Called appears and thereupon the said Aaron Jordine at the prayer of the plfts attorney afd is adjudged to give Speciall Bail to the action afd thereupon a Certain Richard Knight of Somersett County Planter present here in Court undertakes for the said Aaron Jordan that in Case the said Mary Hampton shall recover Judgmt in the plea afd against the said Aaron Jordan or that the said Aaron Jordan shall be there in Convict that then he the said Aaron Jordan shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the Sherr of Somersett County in satisfaction thereof or that he the said Richd Knight will do it for him &c Whereupon the said aaron Jordin in his own proper person Comes & Defends the force and Injury when &c and says that he Cannot gainsay the plft in action afd against him brought nor Can he say but that the Bill or writing Obligatory afd is his act & deed and that the debt therein mentioned is yett due and unsatisfied wherefore the said plft prays Judgmt for her Debt afd and her Costs and Damages sustained by occasion of the Detaining of the same Debt &c Therefore it is Considered by the Justices here the sixteenth day of June ann Dom one thousand seven hundred & twenty four that the said Mary Hampton Recover against the said Aaron Jordan as well the sum of three pounds fifteen shillings and one penny three farthings Curr.t money of maryland and and twenty three Bushells of Indian Corn her Debt afd as also the sum of (283) Two hundred & Eighty Three pounds of tobacco by the Court here adjudged unto her for her Costs and damages sustained by occasion of ye Detaining ye same Debt & ye deft in Mercy &c |
