198 Francis Allen her attorney Complaines that whereas the said Aaron the third day of December one thousand seven hundred and twenty three at the parish & County afd within the Jurisdiction of this Court was indebted unto the said Mary in Eighteen bushells and a peck and a halfe of Indian Corn and two Bushells and the peck and the pack of Indian Corn and two Bushells and a peck ^and a halfe^ of wheat as by a Certain note by the said Aaron signed dated the day and year afd Now here in Court produced may appear and being so thereof Indebted the said Aaron in Consideration thereof the day and year afd at the place afd within the Jurisdiction afd upon himselfe did assume and to the said Mary then and there did faithfully promise that he the said Mary Aaron the said Eighteen Bushells & a peck and ^a^ halfe a peck of Indian Corn and two Bushells a peck & a half of wheat to the said ^Mary^ when he should be thereunto requested he would well and faithfully pay and Content Nevertheless the said Aaron his promise and assumption afd in form afd made Nothing regarding but plotting and fraudulently Intending the said Mary in that part Craftilly and Subtilly to deceive and defraud the afd Eighteen hundred Bushells a peck and a halfe of Indian Corn & two Bushels and a peck and a halfe of wheat to the said Mary he hath not paid or to her for the same in anywise Contented altho' the same to do the said Murphy the said Mary on the fifth day of December afd in the year afd and often afterwards at the parish and County afd within the Jurisdiction afd he was thereunto requested but the same to her hitherto to pay or anywise for the same to Content hath altogether refused and still doth refuse and deny Whereupon the said Mary saith that she is worse and hath damage to the value of three pounds Currt money of Maryland and thereupon she Brings Suite &c F Allen P Quer Pledges Deft Jno Doe Richd Roe Whereupon the said Aaron Jordan being Called appears and thereupon the said Aaron Jordan at the prayer of the plfts attorney is adjudged to give Speciall Bail to the action afd thereupon a Certain Rich.d Knight of Somersett County planter present here in Court undertakes for the said Aaron Jordan that in case the said Mary Hampton shall recover Judgmt in the plea afd against the said Aaron Jordan or that the said Aaron Jordan shall be therein Convict that then he the said Aaron Jordan Shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the Sherr of Somersett County in satisfaction thereof or that he the said Richard Knight will doe it for him &c Whereupon the said Aaron Jordan in his own proper person Comes and defends the force & Injury when &c and says that he Cannot gainsay the plft her action afd so as afd against him Brought nor Can he say but that the said plft ought to recover her damages by occasion of the premisses afd to Eighteen Bushells a peck and halfe of Indian Corn and two Bushells & a peck & a halfe of wheat and Costs of suite against him which the said plft does not gainsay &c Therefore it is Considered by the Justices here the sixteenth day of June ann Dom one thousand seven hundred and twenty four that the said Mary Hampton Recover against the said Aaron Jordan as well the sum of Eighteen Bushells a peck & a half of Indian Corn & two Bushells a peck & a half of wheat her damages afd in form afd Confessed as also the sum of Two hundred & Eighty Two (282) pounds of tobacco by the Court here adjudged unto her for her Costs and Charges by her about her suite in this Behalfe Laid Out & Expended & the deft in Mercy &c |
