seven hundred & twenty two at Robert Mitchells Landing upon Pocomoke River and for ye
payment well and truly to be paid the said George did bind himself his heirs Executors and adm.rs
firmly by the said Bill Nevertheless the said George tho' often thereunto Required the said ten pounds
Currt money afd according to the tenor of the Bill afd to the afd William hath not Rendered but
the same to him hitherto to render hath denyed and still doth deny & unjustly detain to the damage
of the said William of twenty pounds money afd and thereupon he brings suite &c
                                                                F Allen P Quer Pledges deft Jno Doe Richd Roe
    Whereupon the said George Lane in his own proper person ^appears & pray that ye said Wm Noble^ may Give Security for Costs
in Case Nonsuite be obtained against him in the plea afd which is by the Court granted thereupon
a Certain Robert Mitchell of Somersett County Planter present here in Court undertakes for the said
William Noble that in Case he be Nonsuited in the plea afd or otherwise Legally Cost that then the
said William Noble shall pay the Condemnation of the Court ^and all Costs accrewing^ thereupon unto the Said George Lane
or that ^he^ the said Robert Mitchell will do it for him &c

       Whereupon the said George Lane at the prayer of the plfts attorney is adjudged to give
Speciall Bail to the action afd thereupon a Certain John Purnell of Somersett County Gent
present there in Court undertakes for the said George Lane that in Case the said William Noble
shall recover Judgm.t in the plea afd against the said George Lane or that the said George
Lane shall be therein Convict that then he the said George Lane shall pay the Condemnation
of ye Court thereupon or Render his body to the Custody of the sherr of Somersett County
in satisfaction thereof or that he the said John Purnell will do it for him
    Whereupon the said George Lane in his own proper person Comes and defends the
force and Injury when &c and says that he Cannot Gainsay the plft his action afd against
him brought nor Can he say but that the Bill or Writting Obligatory afd is his act & deed and
that ye Debt therein Mentioned is yett due & unsatisfied wherefore the said plft prays Judgm.t
for his debt afd and his Costs and damages sustained by occasion of the detaining the same
debt to him to be adjudged &c
                Therefore it is Considered by the Justices here the sixteenth day of June ann Dom one
thousand seven hundred & twenty three that the said William Noble recover against the said
George Lane as well the sum of ten pounds Curr.t money in Silver or Gold or in pork or Indian
Corn according to act of assembly his debt afd as also the sum of Two hundred & Eighty Nine
289                              pounds of tobacco by the Court here adjudged unto him for his Costs and
Damages sustained by occasion of the detaining the same debt to him to be adjudged & ye Deft in mercy &c
