197 unjustly detain whereupon the said William saith he is worse and hath damage to the value of Eighteen pounds money afd and thereupon he Brings Suite &c F Allen P Quer Pledgs deft Jno Doe Rich Roe Whereupon the said George Lane in his own proper person appears and prays that the said William Noble may give security for Cost in Case Nonsuite be Obtained against him in the plea afd which is by the County Granted thereupon a Certain Robert Mitchell of Somersett County Planter present here in Court undertakes for the said William Noble that in Case he be Nonsuited in the plea afd or otherwise Legally Cost that then he the said William Noble shall pay the Condemnation of the Court and all Costs accrewing thereon to the said George Lane or that the said Robert Mitchell will do it for him Where^upon^ the said George Lane at the prayer of the plfts attorney afd is adjudged to give Speciall Bail to the action afd thereupon a Certain John Purnell of Somersett County Gentl: present here in Court undertakes for the Said George Lane that in Case the said William Noble shall Recover Judgmt in the plea afd against the said George Lane or that the said George Lane ^shall be therein Convict that then he the said George Lane^ shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the Sherr of Somersett County in Satisfaction thereof or that he the said John Purnell will do it for him And the said George Lane in his own proper person Comes & defends the force & Injury when &c and says that he Cannot gainsay the plft the the pl his action afd against him brought nor Can he say but that the wrighting obligatory is his act & deed & that the debt therein Mentioned is Yett due and unsatisfyed wherefore the said plft prays Judgm.t for his debt afd and Costs accordingly sustained by occasion of the detaining the same debt to him to be adjudged &c Therefore it is Considered by the Justices here the sixteenth day of June ann Dom one thousand seven hundred and twenty three that the said William Noble recover against the said George Lane as well the sum of Nine pounds Curr.t money in pork or Corn or Silver Money his debt afd as also the sume 289 of Two hundred & Eighty Nine pounds of tobacco by the Court here adjudged unto him for his Costs and Damages sustained by occasion of the detaining the same deft to him to be adjudged and ye Deft in Mercy &c
and unjustly detained &c And whereupon the said William by Francis Allen his attorney saith that Whereas the said George the sixth day of aprill one thousand seven hundred & twenty One at Coventry parish afd in Somersett County afd within the Jurisdiction of this Court by his Certain Bill Obligatory which the said William with the Seall of the said George signed here into Court brings ye date hereof yt the same day & year did acknowledge himselfe to owe and stand Justly Indebted unto ye afd William in the afd ten pounds to be paid in Silver or Gold or in pork or Indian Corn according to act of assembly at or upon the tenth day of September December in the year one thousand |
