197 Larimore of Somersett County Gentl: Present here in Court undertakes for the said Thomas Prior that in Case the said Charles Ungle shall recover Judgmt in the plea afd against the said R Thomas Prior or that the said Thomas Prior shall be therein Convict that then he the said Thomas Prior shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the sher of Somersett County in satisfaction thereof or that he the said Thomas Larimore will do it for him Whereupon the said Charles Ungle by his attorney afd prays that the said Thomas Prior to his decln in the Plea afd may answer thereupon time is given by the Court unto the afd Thomas Prior untill four of the Clock of this same day to answer unto the afd Plfts decln in the plea afd and it is said to the same deft by the Court that here that he by that same time answer &c And after four of the Clock of the same day the said plft plea by his attorney ^afd^ present ^here^ in Court and the said deft altho' solemnly Called Comes not but makes default whereby the same plft remains against the said ^deft^ thereof undefended &c Therefore it is Considered by the Justices here the Sixteenth day of June ann Dom One thousand seven hundred and twenty four that the said Charles Ungle recover against the said Thomas Prior as well the sume of Eight hundred and Eleven pounds of Certain Damages ^afd^ by occasion of the premisses afd as also the Sum of Three hundred and (357) fifty three pounds of tobacco by the Court here adjudged him for his (353) Costs and Charges by him about his suite in this Behalfe Laid Out & Expended & ye Deft in Mercy &c
And whereupon the said William by Francis Allen his attorney saith that whereas the said George the sixth day of aprill one thousand seven hundred and twenty one at the parish and County afd within ye Jurisdiction of this Court by his Certain Bill Obligatory which the said William with the seall of the said George signed herein Court Brings the date whereof is the same day and year did acknowledge himselfe to owe and stand Justly Indebted unto the afd William in Nine pounds of Curr.t money to be paid in pork or Corn or Silver money at or upon the tenth day of December in the year of our Lord one thousand seven hundred and twenty three at Robert Mitchells Landing one Pocomoke River and for the true performance thereof well and truly to be made and done the said George did Bind himselfe and his heirs firmly by these presents said Bill Nevertheless the said George tho' often by the said William thereunto required ye said Nine pounds according to the Contents of his said Bill unto ye said William he hath not as yett Rendered but the same hitherto to render hath denyed and still doth deny and (unjustly) |
