1724 196 the said Charles by Francis Allen his attorney Complaines that Whereas the said Thomas the thirtieth day of November Ann Dom one thousand seven hundred & Seventeen at the County of Dorchester viz.t at the parish and County of Somersett afd within the Jurisdiction of this Court was Indebted unto the said Charles in Eight hundred & Eleven pounds of tobacco for Levies sherr fees and publick dues and forbearance thereupon to the said Charles then & there due oweing and unpaid as by acco.t thereof hereunto annexed may in Court appear and being so thereof Indebted the said Thomas in Consideration thereof afterwards to witt the day and year afd at the place afd in Consideration thereof upon himselfe assumed and to ye said Charles then and there faithfully dod promise that he the said Thomas the afd Eight hundred & Eleven pounds of tobacco to the said Charles when he should be afterwards thereunto requested he would well and faithfully pay and Content Nevertheless the afd Thomas his promise and assumption afd in form afd made Little regarding but plotting and fraudulently Intending the said Charles in that part Craftilly and Subtilly to deceive and defraud the afd Eight hundred & Eleven pounds of tobacco to the said Charles he hath not paid or to him for the same in anywise Contented altho' the same to do the said Thomas by the said Charles on the first day of March in the year afd & often afterward at the parish & County afd within the Jurisdiction afd he was thereunto requested but the same to him to pay or in any wise to Content hath refused & still doth refuse and deny whereupon the said Charles saith that he is worse and hath damage to the value of sixteen hundred & twenty two pounds of tobacco & thereupon he brings suite &c Allen P Quer Pledgs depo Jno Doe Richd Roe D.r Thomas PRior Cr
honble the Lord proprietarys Justices of the Provinciall Court the above Named Charles Ungle & being sworn upon the holy Evangelist of almighty God declared that the above accot is Just & true and that he had not received any part or pcell thereof from the said Thomas Prior Roger Woollford A Copy of the foregoeing declaration and acco.t were made & sent with the writt in the plea afd Att which said third tuesday of June to witt the sixteenth day of the same Month anno Dom one thousand seven hundred & twenty four Being the day of the return of the said Writt Cometh the said Charles Ungle by his attorney afd and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh & maketh return thereof to the Court here Endorsed in these words following vizt Cepi Corpus P Jos: MccClester Sher Whereupon the said Thomas Prior being Called appears and ^thereupon ye said Thomas Prior^ at the prayer of the plfts attorney afd is adjudged to give speciall Bail to the action afd thereupon a Certain Thomas (Larimore) |
