196 Cometh & maketh return thereof to the Court here Endorsed in these words following vizt Cepi Corpus P Jos: MccClester Sherr Whereupon the said William Pepper in his own proper person Comes & defends the force & Injury when &c and says that he Cause to Gainsay the plft his action afd so as afd against him brought nor Can he say but that the said plft ought to recover his damages by occasion of the premisses afd to one thousand one hundred and Eighty seven pounds of tobo and Costs of suite against him which the said plft does not Gainsay Therefore it is Considered by the Justices here the sixteenth day of June ann Dom One thousand Seven hundred and twenty four afd that the said Robert Martin Recover against the said William Pepper as well the Sum of one thousand one hundred and Eighty seven pounds of tobacco his damages afd in form afd Confessed as also the sum of Three (332) hundred & thirty two pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his suite in this behalfe Laid Out & Expended with stay of Execution untill the tenth day of November Next & ye deft in mercy &c
Whereupon the said William Francis at the prayer of the plfts attorney is adjudged to give speciall bail to the action afd thereupon a Certain Alexander Hall of Somersett County Gentl: present herein Court undertakes for the said William Francis that if in Case the said Capell King shall Recover Judgmt in the plea afd against the said William Francis shall pay the Condemnation of the Court thereupon or render his Body to the Custody of the sher of Somersett County in satisfaction ^thereof^ or that he the ^said^ Alexander Hall will do it for him thereupon the said W.m Francis by George Dashiell his attorney will appears and Imparles till next Court &c
at Dividing Creek the third tuesday of June then next to answer unto Charles Ungle Esqr sherr of Dorchester County of a plea of trespass upon the Case &c and that thereof he should not fail &c And the said Charles Ungle by Francis Allen his attorney Declared against the said Thomas Pryor in the plea afd as followeth viz.t Somersett County fs Thomas Prior late of Dorchester County but now of Spe Stepney parish in Somersett County planter was attached to answer unto Charles Ungle Esq.r Sher of Dorchester County of a plea of trespass upon the Case &c And whereupon (the) |
