all hollows Parish in the County of Somersett planter was attached to answer unto Robert Martin of
a plea of Trespass upon the Case &c    And whereupon the said Robert by Francis Allen his attorney
Complaines that whereas the said William the thit thirtieth day of November ann Dom one thousand
seven hundred and twenty three at the parish and County afd within the Jurisdiction of this Court
was Indebted unto the said Robert in two thousand two hundred thirty and seven pounds of tobacco for
Levies sherr fees and Publick dues and forbearance thereupon to the said Robert then and there due
Owing and unpaid as by account thereof hereunto annexed may in Court appear and being so thereof
Indebted the said William in Consideration thereof afterwards to witt the day & year afd at the place afd in
Consideration thereof upon himselfe assumed and unto the said Robert then and there faithfully
did promise that he the said William the afd two thousand two hundred thirty and seven pounds of tobacco
to the said Robert when he should be afterwards thereunto Requested he would well and faithfully pay &
Content and altho' the said William one thousand & fifty pounds of tobacco percell of the afd two thousand
two hundred thirty and seven pounds of tobacco to the said Robert he hath paid & satisfied
yett as to one thousand one hundred Eighty and seven pounds of tobacco Residue of the afd two
thousand two hundred thirty seven pounds of tobacco the said William his promise & assumption &
afd in form afd made Little Regarding but plotting and fraudulently Intending the said Robert
in that part Craftilly and Subtilly to deceive and defraud the afd one thousand one hundred & Eighty
seven pounds of tobacco to the said Robert he hath not paid or to him for the same in any wise Contented
altho' the same to do the said William by the said Robert on the first day of December in the
year afd and often afterwards at the parish and County afd within the Jurisdiction afd he was thereunto
requested but the same hitherto to pay or in any wise to Content hath refused and still doth
Refuse and deny whereupon the said Robert saith that he is worse and hath damage to the value of
two thousand three hundred seventy and four pounds of tobacco & thereupon he brings suite &c
