195 Justice of our said Court the 21.st day of march in ye 9.th year of our Dominion &c ann Dom 172/3 (F Allen) Thomas Hayward Clk Att which said third tuesday of June to witt the sixteenth day of the same month ann Dom one thousand seven hundred & twenty four being ye day of the return of the said Writt Cometh the said Jno Dennis by his attorney afd and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following vizt To the worshipfull Justices of our Somersett County I humbly Certifie that I have made Known unto the within Named Rachell Powell that she be & appear at the time & place within Contained before the Justices within Mentioned to Shew Cause why the within Named John Dennis should not have his Execution against her for the Debt and Costs within Contained before Mathew Hopkins and Jno Doe good & Lawfull men of my Bailywick as by the within WRitt I am Commanded so answers Jos: MccClester Sherr' Whereupon the said John Purnell by his attorney afd prays that the said Rachel Powell admrx of the same Samuel Powell to his writt of Scirefacias afd may answer but ye said Rachell altho' solemnly Called Cometh not nor shews Cause why &c but makes default whereby the said plft Remains against the said deft thereof undefended &c Therefore it is Considered by the Justices here the Sixteenth day of June ann Dom one thousand seven hundred and twenty four afd that the said John Dennis have his Execution against the said Rachell Powell admrx of the same Samuell Powell dec.d for as well the sume of four hundred & thirty five pounds of tob.o his debt afd as also the sum of two & seven pounds of tobo Costs of Suite In the Judgmt afd Specified as also the sum of Two hundred and sixty 269 Nine pounds of by the Court here adjudged unto him for his Costs and damages sustained by occasion of delay of Execution of the Judgmt afd to be Levied of the goods and Chattells which were of the said Samuell Powell at the time of his death Remaining in the hands of the said Rachell Powell admrx afd remaining to be administred if so much thereof in her hands she hath &c and if so much thereof in her hands she hath not &c then the Costs Last mentioned to be Levied of the proper goods and Chattells of the said Rachell Powell &c
at Dividing Creek the third tuesday of June then next to answer unto Robert Martin of a plea of trespass upon the Case &c and that thereof he should not fail &c And the said Robert Martin by Francis Allen his attorney declared against the said William Pepper in ye plea afd as followeth vizt Somersett County fs William Pepper of (all hollows) |
