194 John Olandman at the prayer of the plfts attorney is adjudged to give speciall bail to the action afd Thereupon a Certain John Purnell and John Dennis Sen of Somersett County Genl present here in Court and undertakes for the said John Olandman that if in Case the said William Whittington shall recover Judgm.t in the plea afd against the Said John Olandman or that the said John Landman shall be therof Convict that then he the said John Olandman shall pay the Condemnation of the Court thereupon or Render his Body to the Custody of the sherr of Somrsett County in satisfaction thereof or that they the said Jn.o Purnell & Jno Dennis will do it for him thereupon the said John Olandman by George Dashiel his attorney appears & Imparls till next Court &c
day of march in the fourth year of our Dominion &c ann Dom One thousand seven hundred & Eighteen Before the worshipfull Charles Ballard Gentl: and his associates then Justices of our said Court (at dividing Creek) and by Consideration of our Said Court Recovered against a Certain Samuel Powell Late of allhollows Parish in the County of Somersett planter as well the sum of four hundred and thirty five pounds of tobacco a Certain Debt as also the sum of two hundred and seven pounds of tobo Costs of Suite whereof he is Convict as by the record and process thereof Remaining Manifestly appears and afterwards the afd Samuel in Allhollows parish in the County afd died Instestate as tis said after whose death administration of all and Singular the goods Chattells Rights and Creditts which were ye afd Samuels at the time of his death to Rachell Powell (widdow of the afd Samuel) Powell in the parish and County afd was Legally Committed and altho' Judgm.t be thereupon Rendered Execution remaineth thereupon as Yett to be done and the afd Debt and Costs as yett remains unsatisfied as by the Insinuation of the said John Dennis wee have in our said Court received Command you that by good & Lawfull men of your Bailywick you make Known unto the said Rachell Powell that She be and appear before the Justices of Our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of June next to shew Cause if anything for herselfe she hath or Knoweth to say why the afd John Dennis should not have his Ex.n of the Debt and Costs afd against her the said Rachell Powell of the goods and Chattells which were the afd Samuell Powell at the time of his death in her hands remaining to be administred if so much thereof in her hands she hath according to the form force and Effect of the recovery afd if to her it shall seem mete and have you then & there the Names of those in whose hands you make ye same Known and this writt Wittness Joseph Gray Gentl: Chief (Justice) |
