in the year One thousand seven hundred and twenty three at the parish afd in the County afd within the Jurisdiction of this Court unlawfull Concealed two Taxables person against the peace &c and also against the form of the act of assembly in such Case made and provided &c L Gale P Lopy On the Back of the foregoeing Bill of Indictm.t it was thus Endorsed viz.t Billa vera Adam Hitch foreman Thereupon Command was Given to the sherr of Somersett County that he should take the said Mary Bolitha if she should be found in his Bailywick and her should safe Keep so that he might have her body before the Justices of his Lordships County Court of Somersett to be held at Dividing Creek the third tuesday of June ^then^ Next to answer unto his Lordship Concerning a Certain Indictm.t against her found &c and that thereof he should not fail &c Att which said third tuesday of June to witt the sixteenth day of the same month ann Dom One thousand seven hundred & twenty four Being the day of the return of the said writt Comes the sherr of Somersett County and makes return thereof Endorst vizt Cepi Corpus P Jos: MccClester Sherr Whereupon the said Mary Bolitha by Francis allen her attorney appears and thereupon the said Levin Gale his Lordships attorney who for his said Lordship in this Behalf prosecutes Cometh here into Court and saith that he will not any further prosecute the same Mary Bolitha on the Indictm.t afd nor further thereof will in anywise Intermeddle &c Wherefore it is Considered by the Justices here that his said Lordship take Nothing by the Indictm.t afd but ^that the said Mary^ be thereof acquitt &c
Driskill if &c to answer &c and afterwards in the same Court Comes the said Richard Driskill in Custody of the sherr and being sett to the Barr is thereupon Instantly demanded how he would acquitt him selfe of the premisses afd upon him Imposed says he is guilty thereof and ^is willing to^ pay thirty Shillings for his fine for ye fact afd Therefore it is Considered by the Justices here that the said Richard Driskill be fined for ^to^ his Lordship the sum of thirty Shillings for the fact afd thereupon the said Richard Driskill is discharged he giveing Security for paymt of the severall Officers the fees due upon the presentm.t afd Whereupon a Certain Moses Driskill present in Court acknowledged himselfe in ten pounds sterr to be Levied &c In Case he doth not pay the severall officers their fees due as afd &c |
