1724 190 sett to the Barr Indictment read pleads not guilty and for tryall thereof putts himselfe upon ye Count^r^y and Levin Gale who for his said Lordship in this Behalfe prosecutes Likewise &c Thereupon Command is given to the sherr of Somersett County that Immediatly he Cause to Come here twelve &c by whom &c who Neither &c to recognize &c because as well &c of which said preceipt the said sherr to witt Joseph MccClester Gent makes return that he hath here ready twelve &c as by his Preceipt he was Commanded and the Jurors of that Jury therein Impannelled being Called Come to witt William Handy, Joseph Houston, Daniell Cordery, Giddion Tilman Richard Philips, Charles Townsend, John Scarbrough, John Gillett, George Townsend ^Houston^ Alex.d Maddux Thomas Baker Mercy Fountain who being duely Elected tryed & sworn to say the truth in the premisses upon their oath do say that the said James Driskill is not Guilty of the premisses as above is Imposed upon him &c Wherefore it is Considered by the Justices that his Lordship the Lord proprietary take Nothing by the Indictm.t afd and that the said James Driskill be thereof acquitted &c thereupon Its ordered by the Court that the said James Driskill give security for paymt of the severall officers their fees due by occasion of the premisses afd Whereupon a Certain Moses Driskill present here in Court acknowledged himselfe to owe & stand Justly Indebted unto his said Lordship the Lord proprietary in the sum of ten pound sterr to be Levied &c In Case he doth not pay the severall officers their fees due by occasion of the premisses afd &c
Tyler give good security for his good Behavior and appearance at next Court but for want thereof the said Richard Tiler is Committed into the Custody of the sherr of Somersett County there to remain the said Sherr present here in Court took Charge of him accordingly &c Afterwards in the same Court the said Richard Tiler together with Adam Hitch his security acknowledged themselves to owe & stand Justly Indebted unto his Lordship the right honourable the Lord proprietary his heirs and successors in the sum of ten pounds sterr Each to be Levied on their Lands and tenements goods or Chattells Joyntly & Severally for the use ye of his said Lordship In Case the said Richard Tyler do not make his personall appearance before the Justices of our County Court to be held at Dividing Creek the third tuesday of August Next to answer unto his said Lordship Concerning all such Matters and things as shall be then & there objected against him on his Lordships Behalfe & to stand & abide ye Judgmt of the Court thereupon and not to depart the same Court without Lycence thereof and in the Mean time to be of the good behaviour to all his Lordships Leige people &c |
