the Jurisdiction of this Court with force and arms one Barrow hogg of the price of twelve shillings Curr.t money of maryland of the goods and Chattells of a Certain Daniell Maddox then & there being found then and there with a Certain staffe did Beat and strike and wound so much that then & there by reason thereof it Instantly did to the great damage of the said Daniel Madox and against the peace of our said Lord Propy his good rule & dignity &c L Gale P Lord py Test William Turpin, Daniell Maddox, Alex.d Maddox, Will Fountain On the Back of the foregoeing Bill it was thus Endorst vizt Billa vera Adam Hitch foreman Thereupon Command was given to the Sherr of Somersett County that he should take the said William Miles Late of Somersett parish in the County afd Carpenter if he should be found in his Bailywick and him should Safe Keep so that he might have his Body Before the Justices of his Lordships County Court of Somersett to be held at Dividing Creek the third tuesday of august then next to answer unto his Lordship Concerning a bill of Indictm.t against him found &c and that thereof he should not fail &c Att which said third tuesday of August to witt the sixteenth day of the same month ann Dom one thousand seven hundred and twenty four being the date of the return of the said Writt Cometh the sherr of Somersett ^County^ and makes return thereof to the Court here Endorst in these words vizt Cepi Corpus P Jos: MccClester Sherr Whereupon the said William Miles appears and being sett to the Barr is thereupon Instantly demanded how he would acquitt himselfe of the premisses above Imposed upon him who thereupon says that of the premisses afd upon him Imposed he is no ways guilty thereof and thereof for tryall putts himselfe upon the Country and Levin Gale who for his said Lordship in this Behalfe prosecutes Likewise Thereupon Command is given to the sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who Neither &c to recognize &c because as well &c of which said preceipt the said sherr to witt Joseph MccClester Gentl: makes return that he hath here Ready twelve &c as by his preceipt he was Commanded and the Jurors of that Jury therein Impannelled being Called Came to witt William Handy, Joseph Houston Daniel Cordery, Giddion Tilman Richard Philips, John Nicholson, John Scarbrough John Gillett, James Caldwell, George Benston, John Murray, Thomas Collier who being duly Elected tryed and sworn upon to say the truth in the premisses upon their Oath do say that the said William Miles is guilty of the premisses as by the Indictm.t above is Imposed upon him Wherefore it is Considered by the Justices that the said William Miles be fined to his Lordship the Lord proprietary the sum of five hundred pounds of tobacco for the fact afd and is Committed into the Custody of the Sherr of Somersett untill he pays the fine afd and the severall officers their fees due upon the Indictm.t afd by occasion of the premisses afd the said sher present took Charge of the said W.m Miles accordingly (and) (thereupon) |
