186 being a Seafaring man being absent from his father John White of annamessex and others his relations this two years past waiting for an opportunity and shall not tarry Long in this County only Coming to se my parents am taken by the Constable in Order to pay my Levy Leaving the same to the worshipfull Bench whether your ^worships^ petitioner ought to pay being in No measure desireous to Continue in the County humbly prays your worships to discharge your petitioner & as in duty bound shall pray &c the petition afd being read and heard Wherefore it is Considered by the Justices here that the said Thomas White be discharged from paying taxes as Long as he useth the sea &c
within the Jurisdiction of this Court did falcely deceiptly and Corruptly pay unto a Certain Joseph Kenier one packt hogshead of tobacco without having the full weight of the Empty hogshead within five pounds Cutt or marked on the Bulge of the said hogshead ag.t the peace of our said Lord proprietary his good rule & dignity and also against the form of the act of assembly in such Case made and provided &c Levin Gale P Dom Prop.r sent to ye grand Jury by order of Court Test Joseph Kenear, Thomas Collier, Jno Elzey, W.m Story, Hugh Porter On the Back of the foregoeing Bill of Indictmt It was thus Endorst vizt Billa vera W.m Turpin foreman Thereupon Command is given to the Sherr of Somersett County ^that he take ye said W.m Thompson^ if &c to answer &c and afterwards in the same Court Comes the Said William Thompson in Custody of the Sherr and being sett to the Bar Indictm.t read pleads not Guilty and for tryall thereof putts himselfe upon the Country and Levin Gale who for his said Lordship in this Behalfe prosecutes Likewise Whereupon the said William Thompson Relinquisheth his verification afd and says that of the premises afd by the Indictmt above is Imposed upon him he is guilty thereof and submits to the mercy of the Court &c Wherefore it is Considered by the Justices here that the said William Thompson be fined to his Lordship the Lord proprietary the sum of six hundred pounds of tobacco for the fact afd and is Committed into ye Custody of the Sherr of the County afd untill such time as he pays the fine afd & the severall officers their fees due upon the Indictmt afd by occasion of the premisses afd &c Whereas a Certain Darby Cornelia and Mary Cornelia being formerly Bound by this Court unto a Certain William Bolitha the said Will.m Bolitha had obliged himselfe to Learn the said Darby Cornelia the act of Navigation and had given security to perform the same but same that the said W.m Bolitha is dead & there was no possibility of the said Darby Cornelia Learning the said act And whereas a Certain Thomas Dixon and Peter Frazer (Securitys of the afd William Bolitha for the performance of the afd Indentures) being present here in Court Its ordered by the Same Court that ye said Thomas Dixon and Peter Frazer take ye Said Children into their Case & Custody & that they Comply with their former Indentures &c |
