(18) and Province and the form of the Statute and acts of assembly thereof had and made used But we will not that you Proceed in any the Cases afd to take Life or Member But that in Every such Case you send the Prisoners with their Indictments and whole matters depending Before you to Our Justices of Our next Provinciall Court to be held for this Our province be it whomsoever or wheresoever to be holden thereto be tryed and Wee Command you and of Every of you Deligently to attend the Keeping the Peace ordinances and Statutes and all and Every the premisses and that at your County Courts you make Inquisition and hear and determine as afd doing therein what to Justice appertains according to the Laws and Customs of the Kingdom and Province afd and further we Constitute ordain and appoint you the said Charles Ballard Joseph Gray Samuel Hopkins William Whittington W.m Planner John Purnell John Jones W.m Fausitt John Smith William Stoughton John M.ccChester John Handy and James Dashiell or any three or more of you as afd to Issue Out writts Preceipts Process and attachments and hold Plea of Oyer and terminer of all actions Popular and upon the statutes and of all actions Personall of whatsoever wherein ye Demand doth not Exceed the sum of One hundred pounds sterling or thirty thousand pounds of tobacco and all actions now depending before you be ye Demand how great soever and after Judgm.t Execution to award in all such Causes and actions afd according to ye Laws Orders and Customs of that part of the Kingdom of England Called Great Brittain as of this Our Province of maryland in which said actions so to be tryed Wee doe Constitute Ordain and appoint you the said Charles Ballard Joseph Gray Samuel Hopkins W.m Whittington W.m Planner John Purnell John Jones W.m Fausett John Smith William Stoughton John Macchester John Handy James Dashiell and none Others to be Judges and alsoe by these Presents wee ^doe^ Command ye Sherr of Our Said County of Sommersett that at ye severall Courts to be held for Our Said County he give his attendance and Cause to Come Before you or any three or more of you as afd so many good and Lawfull men of his Baliwick Out of Each and Every hundred thereof in whom the truth of the matter in the Premisses may be the Better Known and Enquired of Lastly you shall Cause to be Brought Before you at your said Courts all writs Preceipts Process to your Courts Jurisdiction belonging that ye same may be Inspected and by due Course of Law determined Wittness our trusty and well beloved Charles Calvert Esqr Capt Generall and Governour in and over this Our Province of Maryland this 17.th day of aprill in the 8:th year of Our Dominion &.c Ann Dom 1728 Cha: Calvert On the back of ye foregoing Commission it was thus Endorst vizt Maryland ss.t Charles absolute Lord and Proprietarie of the Provinces of maryland and avalon Lord Baron of Baltemore &.c To Joseph Gray Samuell Hopkins W.m Whittington W.m Planner John Purnell ^and^ John Jones of Sommersett County Gent Greeting wee do hereby Authorize and Empower you or Either of you to administer ye severall Oaths appointed by act of assembly as also the Oath of Justice to Charles Ballard William Fausitt John Smith ^of Baltemore hundred^ William Stoughton John Macchester John Handy James Dashiell or any of them and you the said Charles Ballard W.m Fausett John Smith W.m Stoughton John Macchester John Handy and James Dashiells or any of you haveing taken the said Oaths (are doe) |
