177 he should be thereto Requested Nevertheless he the said John his promise and assumption afd in form afd made Little Regarding but fraudulently Intending him the said Thomas in that Case to defraud & deceive altho' often thereunto requested he hath not paid but the same to pay hath refused and still doth refuse to the damage of the said Thomas of seventeen hundred and twenty four pounds tobacco and thereupon he brings this suite &c
hereunto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the seventeenth day of March ann Dom one thousand seven hundred & twenty three Comes again the said plft by his attorney afd and prays that the said deft to his decl.n in the plea afd may answer but the said deft altho' Solemnly Called Comes not but makes default whereby the said plft remaines against the said deft thereof undefended &c But because it is unknown unto the Justices here what damages the said plft hath sustained by occasion of the premisses afd thereupon at the prayer of the plfts attorney afd the Justices here do asses the damages of the said plft (according to act of assembly in Such Case provied) by occasion of the premisses afd besides his Costs and Charges in this behalfe Expended to Eight hundred & sixty two pounds of tobacco &c Therefore it is Considered by the Justices here the same day & year Last mentioned that the said Thomas Dashiell Recover against the said John Taylor as well the sum of Eight hundred and sixty two pounds of tobo his damages afd in form afd by the Justices assessed as also the sum of three hundred & seventeen pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him ^about his suite^ in this Behalfe Laid out and & Expended & ye Deft in Mercy &c
County afd within the Jurisdiction of this Court in Consideration that the afd Nathaniel at the proper Cost & Charge of the same Nathaniel had at ye Especiall Instance and Request of the same Eliz whilst She was sole Transported and brought & Broug the same Eliz with severall of her ^servants &^ sundrey of her & Goods of her Goods from the Island of Bermuda Into Somersett County afd upon her self assumed & to ye said Nathaniell then & there faithfully promised that she when (afterward) |
