1723 177 year and place Last above mentioned upon himselfe assumed and to the said Arnold Elzey then and there faithfully promised that he when afterwards he should be thereunto required the afd sum of twenty one pounds ten Shillings to the same Arnold Elzey he would well and faithfully Content and pay Nevertheless the same Edmond Hough his promise and assumption afd in form afd made Little regarding but plotting and fraudulently Intending the afd sum of twenty one pounds ten Shilling's sterr or any part thereof to the afd Arnold altho' the same Edmond by the same Arnold afterwards viz.t the thirtieth day of June one thousand seven hundred & twenty three at Somersett parish afd within the Jurisdiction afd was thereunto requested hath not paid or to him in any wise for it Contented but the same Edmond the same to him hitherto to pay or him for it in any wise Contented hath altogether Refused and still doth refuse and deny whereby the same Arnold saith he is the worse hath damage to the value of and thereof he Brings this Suite &c L Gale P Quer pledges &c Jno Doe Rich Roe And the said Edmond Hough by Francis Allen his attorney Comes and defends the force and Injury when &c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the Ninteenth day of November ann Dom One thousand seven hundred and twenty three Come againe the Said partyes by their attorneys afd and the said deft by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the seventeenth day of march ann Dom one thousand seven hundred and twenty three Come again the said partys by their attorneys afd and the said deft by his said attorney says that he Cannot gainsay the plft his action afd so as afd against him brought nor Can he say but that the said plft ought to recover his damages by occasion of the premisses afd to twenty six pounds five shilling's sterling money and Costs of Suite against him which the said plft does not gainsay &c Therefore it is Considered by the Justices here the same day and year Last mentioned that ye said Arnold Elzey Recover against the said Edmond Hough as well the sum of twenty six pounds five shillings sterling mony his damages afd in form afd Confessed as also the sum of four hundred (417) and Seventeen pounds of tobacco by the Court he was adjudged unto him for his Costs and Charges by him about his Suite in this Behalfe Laid Out & Expended and ye Deft in mercy &c
the Jurisdiction of this Court was Indebted unto the said Thomas in the sum of Eight hundred and sixty two pounds of tobacco as P accot hereunto annext may in Court appear and the said John Being Indebted as afd for and in Consideration afd at ye time and place afd did upon himselfe assume and promise that the afd Eight hundred and sixty two pounds of tobacco he would well and truly Content and pay when (the) |
