176 William Holland, Isaac Williams, John Beavins, William Bratton, David Hazard, John Patrick Jun Adam Spence Sen Edmond Hough, William Mills, who being duely Elected tryed & sworn to say the truth in the premisses upon their Oath do say that the said John Larimore hath sustained damage by occasion of the premisses to teen shillings &c wherefore the damages afd found being not within the Jurisdiction of this Court to give Judgm.t on the verdict afd for the plft Therefore it is Considered by the Justices here the seventeenth day of march ann Dom one thousand seven hundred & twenty three afd that the said John Larimore take Nothing by his writt & decl.n afd but be in mercy for his falce Clamour and that the said John Collins goe thereof without day &c and also it is Considered by the Justices here that the said John Collins Recover against the said John Larimore as well the sume of six hundred & thirty 635 five pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his defence in this behalfe Laid Out & Expended according to the form of the Statute &c
at Somersett Parish in the County afd within the Jurisdiction of this Court useing of trade and Commerce according to the Custome of merchants and Others of this the province of maryland and the City of Exon in England of old used made and drew his Certain first bill of Exchange with his proper hand subscribed bearing date the day and year afd to John Colsworthy and Humphry Boden Merchants in Exon Residing and Negotiating directed and by the same Bill requested the same John Colsworthy and Humphry Boden at thirty days sight of such Bill of Exchange his second or third not being paid to pay unto the afd Edmond Hough or his order twenty one pounds ten shillings sterling for value of him received which Bill afterwards at Somersett Parish within the afd Jurisdiction and before sight thereof had by the afd John Colsworthy and Humphry Boden the afd Edmond Hough using trade and Commerce according to the Custome of merchants &c afd by Endorsment with his proper hand subscribed according to the Custome of merchants afd ordered the afd Sum of twenty one pounds ten Shillings Sterlling to to be paid unto the afd Arnold Elzey or his order for value received whereof the afd John Colsworthy & Humphry Boden afterwards on the thirteenth day of march one thousand seven hundred & twenty two at Exon viz.t at Somersett parish afd within the afd Jurisdiction had Notice and then and there was Requested to pay the afd sum of twenty one pounds ten shillings ster to the order of the afd Arnold Elzey and the same Arnold Elzey says that ye afd John Colsworthy and Humphry Boden or Either of them after thirty days sight of the afd first bill and Notice as afd hitherto hath not paid to the afd Arnold Elzey or his order the afd sum of twenty one pds ten shillings sterr and that for want of paymt thereof the afd Arnold Elzey after thirty days sight of the afd first bill and notice as afd by the afd John Colsworthy and Humphry Boden had Notice on the thirteenth day of march One One thousand seven hundred and thirty ^twenty^ two afd at Exon afd viz.t at Somersett Parish afd within the Jurisdiction afd had Notice Protested or Caused to be protested ye afd first bill of Exchange the second or third not being paid according to ye Custome of merchants afd whereof the said Edmond Hough afterwards that is to say the tenth day of June one thousand seven hundred and twenty three at the parish of Somersett afd within the afd Jurisdiction had notice and in Consideration thereof ^and^ of the Custome of merchants afd the same Edmond Hough the day (year) |
