176 Shallop with twelve hundred red Oak Boards of the goods and Chattells of the afd John Larimores on board her of the value of four pounds Currant mony of maryland from Tipquin in the Parish afd within the afd Jurisdiction unto the river Patuxent and there to deliver the said Boards to a Certain Levin Covington for a Certain allowance or sallery afterwards to be paid him of thirteen shillings and six pence Curr.t money afd for goeing Skipper of such Shallop and Carrying and delivering such Boards at Patuxent afd to the afd Levin Covington and whereas the afd John Collins afterwards to witt the afd tenth day of May One thousand seven hundred and twenty two at the parish afd within the afd Jurisdiction did receive of the afd John Larimore the afd Shallop & boards afd in form afd as Skipper of the said Shallop to be Caried and delivered to the afd Levin Covington at Patuxent the said John Collins the Shallop and Boards afd afterwards to witt the Eleventh day of may One thousand seven hundred and twenty two at the Parish afd within the afd Jurisdiction did Keep and Carry so negligently and Improvidently that seven hundred of the Boards afd of the afd John Larimores by the Negligent Custody of him the said John Collins were then & there Lost taken & Caried away by persons to him the said John Larimore altogether unknown so that he the afd John Collins the boards afd Last mentioned of the value of forty Six Shillings and Eight pence Curr.t money afd to the afd Levin Covington at Patuxent hath not delivered and Caried altho' the afd John Collins the same to doe afterwards viz.t the fifteenth day of may One thousand Seven hundred & twenty two at the Parish afd within the afd Jurisdiction was thereunto by the said John Larimore requested whereby the said John Larimore says he is the Worse and hath damage to the value of ten pounds Curr.t money &c of maryland & thereof he brings this Suite &c Levin Gale P Quer pledges &c Jno Doe R Roe And the said John Collins by George Dashiell his attorney Comes and defends the force and Injury when &c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to ye plft also Att which said next Court to witt the Ninteenth day of November ann Dom one thousand seven hundred and twenty three Come again the said partys by their attorneys afd and the said deft by his said attorney prays further Leave to Imparle hereunto untill then Next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the seventeenth day of March ann Dom one thousand seven hundred and twenty three Come again the said partys by their attorneys afd and the said deft by his said attorney as before defends the force and Injury when &c and saith that he is not guilty of the premisses as the said John Larimore above against him in declaring hath Complained and thereof for tryall putts himselfe upon the Country &c G: Dashiell P Deft And ye Plft in Like manner Levin Gale P Quer Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to recognize &c because as well &c of which said preceipt the said sherr to witt Joseph MccClester Gent Now hereat this day to witt the same day and Year Last mentioned makes return that he has here ready twelve &c as by his preceipt he was Commanded and Now hereafterwards to witt the same day and year makes return Come as well the said plft as the said deft by their attorneys afd and the Jurors of that Jury Impannelled being Called Came to witt Thomas Peall John Dennis John White Marumsco (Wm) |
