175 but the Cattle afd afterwards to witt the tenth day of august in the year afd at the parish and County afd within the Jurisdiction afd the said Joyce whilest she was sole to her own proper use did Convect and dispose whereupon the said Anne saith she is worse and hath damage to the value of twelve pounds ten Shillings Curr.t money of maryland and thereupon she brings Suite &c Allen P Quer Pledges deft Jno Doe & Richd Roe And the said Sturges Dickson and Joyce his wife by Levin Gale their attorney Come and defend the force and Injury when &c and prays Leave to Imparle hereunto untill the next Court and they have it and the same day is given to the plft also Att which said next Court to witt the Ninteenth day of November ann Dom one thousand seven hundred and twenty three Come again the said partys by their attorneys afd & the said deft by their said attorney pray further Leave to Imparle hereunto untill the next Court and they have it and the same day is Given to the plft also Att which said next Court to witt the seventeenth day of march ann Dom one thousand seven hundred and twenty three Come again the said partys by their attorney afd and the said deft by attorney of the same defts say that he is not Informed by ^the same defts^ his Clyants of any answer by the same defts to the afd Plft in the plea afd to be given and Nothing Else thereof says whareby the same plft remains against the afd defts thereof undefended But because it is unknown unto the Justices here what damages the said Ann Selby hath sustained by occasion of the premisses afd Thereupon the Justices here at the prayer of the plfts attorney afd and by Consent of the afd Defend.ts according to act of assembly do assess the damages of the said plft by occasion of the premisses afd beyound her Costs and Charges in this behalfe Laid Out & Expended to four pounds fifteen shillings Curr.t money &c Therefore it is Considered by the Justices here the same day and Year Last mentioned that the said Ann Selby Recover against the said Sturges Dickson & Joyce his wife as well the sume of four pounds fifteen shillings Currt mony her damages afd in form afd by the Justices assessed as also the sum of Seven hundred & Seven 1707 pounds of tobacco by the Court here adjudged unto her for her Costs and Charges by her about her suite in this Behalfe Laid Out and Expended & the defts in mercy &c
at the parish afd within the Jurisdiction of this Court was and is a person that Commonly useth to goe by water Skipper or master of a Shallop or vessell and to take upon himselfe the Charge and Care of the said Shallop or vessell or Loading and such things as belongs to the said vessell or be put on Board her for a resonable Lawfull hire or sallery according to the usuall agreement and paym.t in that behalfe to be made and had and also that whereas according to Law and Custom of great Brittain and this province of maryland all such Skippers or Masters of Shallops or vessells who doe Receive goods and Chattells of Broad any manner of persons to be Carried and delivered in such Lawfull manner and place as by them shall be agreed upon for a reasonably and Lawfull sallery or hire to them therefore to be given and paid are Bound to Keep and Carry and deliver the goods and Chattells of such persons so as afd Received in such manner and to such place as is agreed upon as afd safe and without Loosing Spoiling or withholding them or any part of them so that by default of such skipper or master of such Shallop or Vessell slo damage should happen to such persons by ye Carrying their Cariages and whereas the afd John Collins the tenth day of may one thousand seven hundred & twenty one at ye parish afd within the Jurisdiction afd had taken upon him^selfe^ the Charge of being Skipper or master of a (Shallop) |
