1723 175 defend the force and Injury when &c and pray Leave to Imparle here unto untill the next Court and they have it and the same day is given to the plft also Att which said next Court to witt the Ninteenth day of November ann.o Dom one thousand seven hundred and twenty three Come again as well the said plft by his attorney afd as the said defts by their attorney afd and the said defts by their said attorney pray further Leave to Imparl here unto untill the next Court and be hitherto they have it and the same day is given to the plft also att which said next Court to witt ye seventeenth day of March anno Dom One thousand seven hundred and twenty three Come again as well the said plft as the said defts by their attorneys afd and the said defts by their said attorney say that they Cannot gainsay but that the said Plft ought to have his Execution of the Judgmt afd to be Levied of the goods and Chattells which were of the said Thomas Taylor at the time of his death when they shall hereafter Come to their hands to be administred &c Therefore it is Considered by the Justices here the same day and year Last mentioned that the said Benjamin Wailes have his Execution against the said Henry Williams and Alice his wife admrx of the same Thomas Taylor dec.d for as well the sum of Eight hundred & Eighty five pounds of tobacco a Certain debt as also the sum of two hundred and fifteen pounds of tobacco Costs of Suite in ye (261) Judgm.t afd specified as also the sum of Two hundred & sixty one pounds of tobacco by the Court here adjudged unto him for his Costs and damages sustained by occasion of delay of Execution of the Judgmt afd to be Levied on the goods and Chattells which were of the said Thomas Taylor at ye time of his death and which to the hands of the said Henry Williams and Alice his wife admrx as afd hereafter shall Come to be administred &c
seven hundred and twenty at all hollows parish in the County afd within the Jurisdiction of this Court was possessed of One Cow and Calfe of the price of forty shillings Currt money of maryland one Cow of the price of thirty five shillings Like money and two two years old heifers of the price of fifty shillings Like mony as of her proper Cattell and being so of the same possessed the said Anne the day year and place afd within the afd Jurisdiction the said Cattell out of her hands and possession Causually Lost which said Cattle afterwards to witt the second day of august afd in the year afd at the parish and County afd within the Jurisdiction afd to the hands and possession of the afd Joyce whilest she was sole Came Nevertheless the said Joyce whilest she was sole well Knowing the Cattle afd to the the proper Cattle of her the said Ann and to her the said Ann of Right to belong and appertain but plotting and fraudulently Intending the said Ann in that part Craftily and Subtilly to deceive and defraud the Cattle afd unto her the said Ann hath ^not^ delivered altho' the same to do the said Joyce whilest she was sole to witt on the third day of August One thousand seven hundred and twenty afd and often afterwards at the parish and County afd within the Jurisdiction afd she was thereunto requested (but) |
