170 upon himselfe in manner & form as the afd James hath above against him Complained and of this he putts himselfe upon the Country &c L Gale P Deft and ye plft in Like Manner F Allen P Qrte Thereupon Command is given to the sher of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to recognize &c because as well &c of which said preceipt the said sherr to witt Joseph MccClester Gent Now hereat this day to witt the same day & Year Last mentioned makes return that he has here ready twelve &c as by his said preceipt he was Commanded and Now hereafterwards to witt the same day and year Comes as well the said plft as the said deft by their attorneys afd and the Jurors of that Jury Impannelled who being Called Likewise Came to witt Thomas Peall, John Dennis Sen John White Marumsco, William Holland, Isaac Williams John Beavins, William Bratton, David Hazard John Patrick Jun.r, Adam Spence Sen.r Edmond Hough ^Wm Mills^ who being duely Elected tryed and sworn to say the truth in the premises upon their Oath do say that the said John Henderson did not assume upon himselfe in manner and form as the afd James Feillett above against him hath Complained &c Therefore it is Considered by the Justices here the seventeenth day of march ann Dom one thousand seven hundred & twenty three that the said James Feillett take Nothing by his writt afd and decln afd but be in mercy for his falce Clamour & that the said John Henderson goe thereof without day 1276 and also it is Considered by the Justices that the said John Hendson recover agt the said James (490) Feillett the sum of thirteen hundred pounds of tobo by ye Court here adjudged unto him for his Costs and Charges by him about his defence in this Behalfe Laid Out and Expended according to the form of the statute &c
Rogers ye fourth day of October One thousand seven hundred and teen in Maryland vizt in Coventry parish in the County afd within the Jurisdiction of this Court useing trade and Commerce according to the Costome of merchants and others of this the province of maryland and the City of London in England of Old Used made and drew his Certain first Bill of Exchange with his proper hand Subscribed bearing the day and year afd to a Certain John Hyde Merch.t in London residing and negotiating directed and by the said Bill requested the said John Hide at thirty days sight of such Bill of Exchange his second and third not paid to pay unto a Certain Edward Martin or his order the sum of four pounds Ninteen Shillings sterr which Bail afterwards to witt the tenth day of (August) |
