Somersett County Greeting we Command you that you attach any the goods and Chattells Rights or Creditts of Thomas Crawley of Vergenia if they shall be found in your Bailiwick to the value of one thousand pounds of tobacco and when you have the same attached or any part thereof the same in your Custody Safe Keep so that you have the same Before the Justices of Our County Court to be held at dividing Creek in Somersett County afd the third tuesday of march next then and there to be Condemned according to act of assembly to and for the use of a Certain John Handy and Jane his wife Exerx of the Last will and testament of John Winder dec.d unless the said Thomas Crawley by himself or his attorney shall appear and answer unto the said John Handy and Jane his wife Exrx as afd of a plea of trespass upon the Case &c according to Law and that by good & Lawfull men of your Bailywick you make Known unto the person or persons in whose hands you make the same attachm.t that he she or they be and appear before the Justices of our Said Court to be held as afd to shew Caus if any he she or they be and appear have why the same goods Chattells Rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made according to the form of the act of assembly in such Case made and provided if to him her or them it shall seem mett and how you shall Execute this writt that you make Known unto our said Justices at the day & place afd and have you then & there this Writt Wittness Charles Ballard Gent Cheife Justice of Our said Court the 19.th day of December in the Eighth Year of Our Dominion &c ann Dom 1723 (G Dashiell) Thomas Hayward Cler Att which said third tuesday of March to witt the seventeenth day of the same month ann Dom one thousand seven hundred & twenty three Being the day of the return of the said Writt Cometh the said John Handy and Jane his wife Exrx as afd by George Dashiell their attorney and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh & maketh Return thereof to the Court here Endorst in these words following vizt To the Worshipfull Justices within Mentioned I humbly Certifie that I have attached as the goods and Chattells of the within Named Thomas Crawley in the hands of Joseph MccClester that he be & appear at the time & place within Contained to shew Cause &c Before John Pitts and William Booth good & Lawfull men of my Bailywick so answers Jno Purnell Cornll Whereupon the afd Joseph MccClester Garnishe of the afd Thomas Crawley appears in his own proper person and says he Cannot gainsay but that he hath of the Rights and Creditts of the said Tho.s Crawley to the sum of one thousand pounds of tobacco nor but that the same Ought to be Condemned in his hands for the use of the said John Handy & Jane his wife Exrx as afd as of the Rights & Creditts of the said Thomas Crawley which the said plft does not gainsay Whereupon the said John Handy & Jane his wife Exrx as afd by their attorney afd prays that (the) |
