162 These are therefore to Command you to take the said Somersett Dickenson and him safe Keep so that you have his Body Before the Justices of Our County Court Now sitting at Dividing Creek to answer unto the Complaint of the said Cornelius Morris afd hereof you are not to fail at your perill and this shall be your Sufficient warrt and have you then & there this writt Wittness Jos: Gray Gent Cheife Justice of Our Said Court &c Whereupon the Sher Returns that he hath here Ready the said Somersett Dickenson to answer as by his said Preceipt he was Commanded Now here at this day to witt the seventeenth day of march ann Dom one thousand seven hundred & twenty three Personally appeared here in Court as well the said Somersett Dickenson as the said Cornelius Morris in their Own proper persons and their severall allegations being heard as well on the Part of the Said Somersett Dickenson as on the part of the said Cornelius Morris and the Premisses fully and Maturally Considered &c It's Ordered by the Justices that the said Somrsett Dickenson give good Security to bear the Parish harmless that should happen or accrew by his neglect in not takeing Care of the said Cornelius Morris and to find & provide for the said Cornelius a sufficient Maintainance of all such Necessarys as may be requisite for the said Cornelius dureing his naturall Life but for want of such security the Court do agree with a Certain Rowland Beavins to Keep the said Cornelius Morris untill the next Court and to find and provide for him such things as may be Necessary during that time and for so doing the said Cornelius Rowland Beavins shall be allowed what the said Court shall think Reasonable &c
his ^Lordships^ Our County Court of Somersett to be held at Dividing Creek the third tuesday of march ^then^ next to answer unto Roger Nicholson of a plea of trespass upon the Case &c and that thereof he should not fail &c Att which said third tuesday of march to witt the seventeenth day of the same month Being the day of the return of the said Writt ann Dom one thousand seven hundred & twenty three Cometh the said Roger Nicholson by Francis Allen his attorney and the Sherr of Somersett County Likewise Cometh and maketh Return thereof to the Court here Endorst in these words following vizt Cepi Corpus p me Jos: MccClester Sher Whereupon the said William Linsey by Levin Gale his attorney Comes & defends the force & Injury when &c and offers himselfe against the said Roger Nicholson in the plea afd but the said Roger Nicholson altho's solemnly Called Comes not nor is his writt in the plea afd further prosecuted against the said W.m Linsey Therefore it is Considered by the Justices here the seventeenth day of march ann Dom one thousand seven hundred and twenty ^three^ that the said Roger Nicholson & his pledges of Prosecuting be In Mercy &c and Lett the Names of his said Pledges he sought for &c and that the said William Linsey goe thereof without day and also it is Considered by the Justices here that the said 258 Willm Linsey Recover agt the said Roger Nicholson the sum of pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his defence in this Behalfe laid Out & Expended according to ye form of ye statute & yt he have thereof his Exn |
