159 of this Court in and upon a Certain John Newbold in the peace of God and our said Lord proprietary then and there Being an assault made and him the said John Newbold then & there Beat wounded and Evilly treated so that of his Life it was dispaired and other harmes to him then & there did to the great damage of the said John Newbold and against the peace of our said Lord prorty his good rule & dignity L Gale P Dom Propr Test Thos Layfield, Jno Newbold On the Back of the foregoeing Bill it was thus Endorst viz.t Ignoramus Adam Heatch foreman Thomas Purnall of Somersett County and wife Exrx of Daniel Selby being sumoned to give Security for said Selby's Estate appeared and was accordingly discharged there being no Orphan's &c William Ennis Ex.r of Nathaniel Ennis being sumoned to give Security for the said Ennis Estate made his appearance and forasmuch as it seemeth to the Court here that there was noe Necessity for the said William Ennis to give security he is accordingly discharged &c Mary Jarrat Exrx of James Jarrat being somoned to give security for the said James Jarrats Estate made her appearance and forasmuch as there was noe Orphans the said Mary Jarrat is by ye Court discharged &c Elianor George and Samuel Truett Ex.rs of George Truett being somoned to give security for said George Truett's Estate appears and forasmuch as it seemeth to the Court that there is no Necessity of their giving security they are accordingly discharged &c Henry Miles Etuxor Executor of Alice Mills being sumoned to give security for the said Alice Miles Estate appears and forasmuch as it seemeth to the Court that the said Henry Miles hath paid away the Estate is thereupon discharged &c Somersett County fs: Know all men by these presents that I Thomas Dashiell of Somersett County Gentl: do hereby renounce and Revoke a warrt of attorney by me formerly given to Francis Allen to be my attorney in Somersett County Court as wittness my hand and and seal this 17.th day of march ann Dom 1723 Sealed and delivered in Presence of us Tho: Dashiell (Seal) John Scott Whereas a Certain William Fasitt Gent One of the Justices of Somersett County being appointed by this Court to Limitt and Lay out the road Between Mad.m Mary Hamptons plantation at the sea side and a Certain Jeremiah Townsend in Pursuance to which order appeared at the same place and did Lay out the said Road by Consent of said Townsend but now hereafterwards here in Court the Justices Juridically sitting the said Jeremiah Townsend present in Court said that Capt William Fasitt acted very unfairly thereupon at the prayer of Mr Levin Gale Its ordered by the (Court) |
