1723 158 tobacco according to the form and Effect of the Condition which to him he Ought to have paid &c Therefore it is Considered by the Justices here the seventeenth day of March ann Dom one thousand seven hundred and twenty three afd that the said Margarett Lady Baltemore Exrx of the right honrble Charles Lord Baron of Baltemore dec.d Recover against the said Merrick Ellis and Alice his wife Exrx of the afd Samuel Worthington dec.d as well the sum of two thousand four hundred pounds of tobacco the debt 853 afd as also the sum of Eight hundred & fifty Three pounds of tobacco by the Court here adjudged unto her for her Costs and damages sustained by occasion of the detaining of the same debt to be Levied of the goods and Chattells which were of the said Samuel Worthington at the time of his death in the hands of the said Merick Ellis & Alice his wife Exrx as afd ^remaining^ to be administred if so much thereof in their hands they have &c and if so much thereof in their hands they have not &c then ye afd Costs of Suite to be Levied of the proper goods and Chattells of the afd Merick Ellis & Alice his wife & the defts in mercy &c
in and upon a Certain John Newbold in the peace of God and our said Lord proprietary then and there being an assault made and him the said John Newbold then and there Beat wounded and Evilly treated so that of his Life it was dispaired and other harms to him then and there did to the great damage of the same John Newbold and against the peace of our said Lord proprietary his good rule & dignity &c Test Thomas Layfield, John Newbold L. Gale P Dom Pro p.r On the back of the foregoeing Bill it was thus Endorst vizt Ignoramus Adam Heatch foreman
