157 did assume upon himse^l^fe in manner and form as the said Robert above against him hath Complained Yett the said William further saith that since the makeing the assumption afd by him the said William hath an acco.t of his Own which hath accrewed due to him the said William from the said Robert vizt at Stepney parish in Somersett County within the Jurisdiction of this Court amounting to the Sum of One hundred & seventy five pounds of tobacco to witt on the tenth day of June one One thousand seven hundred and twenty three and this he is ready to verifie and prays that he may be admitted to discount the same against the debt of the said Robert according to the form of an act of assembly of this province now in force in such Cases made & provided Dashiell P Deft
Last pleaded Comes not nor is his declaration in the plea afd further prosecuted against the said William Shurman Therefore it is Considered by the Justices here the seventeenth day of march ann Dom One thousand seven hundred & twenty three that the said Robert Martin and his pledges ^of Prosecuting^ that is John Doe and Richard Roe be in mercy &c and that the said William Shurman goe thereof without day and also it is Considered by the Justices here that the said William Shurman 297 Recover against the said Robert Martin as well the sum of Two hundred & Ninty Seven pounds of tobacco by the Court here adjudged unto him for his Costs and Charges by him about his defence in this Behalfe Laid Out & Expended according to the form of the statute and that he have thereof his Execution &c
and Ex.rx of the Last will and testament of the Right honourable Charles Lord Baron of Baltemore Lately dec.d of a plea that they Render unto her two thousand four hundred pounds of good sound merchantable Leafe tobacco and Casque to Contain the same which from her they unjustly detaine &c And whereupon the said Margarett Lady Baltemore by Francis Allen her attorney saith that whereas the said Samuel Worthington in his Life time to witt the first day of October ann Dom One thousand six hundred and Ninety four at the hundred and County afd within the Jurisdiction of this Court by his Certain Writing Obligatory which the said Margarett Lady Baltemore with the seall of the said Samuel Worthington signed here into Court Brings the date whereof is the (same) |
