156 And whereupon the said Robert by Francis Allen his attorney Complaines that whereas the said William the thirtieth day of November ann Dom One thousand seven hundred and twenty two at the Parish and County afd within the Jurisdiction of this Court was Indebted unto the said Robert in four hundred Ninty Seven pounds of tobacco for Levies publick dues and forbearance thereupon to the said Robert then and there due Owing and unpaid as by an acco.t thereof hereunto annexed may in Court appear and being so thereof Indebted the said William in Consideration thereof afterwards to witt the day and year afd at the place afd upon himselfe assumed and to the said Robert then and there did faithfully promise that he the said William the afd four hundred & Ninty Seven pounds of tobacco to the said Robert when he should afterwards thereunto ^be^ requested would well and faithfully pay and Content Nevertheless the said William his promise and assumption afd in form afd made Little regarding but plotting and fraudulently Intending the said Robert in that Part Craftily and Subtilly to deceive & defraud the afd four hundred and Ninty seven pounds of tobacco to the said Robert he hath not paid or to him for the same in anywise Contented altho' the same to do the same William by the same Robert on the first day of December in the year afd and often afterwards at the county and parish afd within the Jurisdiction afd he was thereunto requested but the same to him to pay or in anywise to Content hath refused and still doth Refuse and deny whereupon the said Robert saith he is worse and hath damage to the value of Nine hundred Ninety four pounds of tobacco and thereupon he brings Suite &c Allen P Quer Pledges dep Jno Do R Roe
when &c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the Eighteenth day of June ann Dom one thousand seven hundred and twenty three Come again as well ^the said^ plft as the said deft by their attorneys afd and the said deft by his said attorney prays further Leave to Imparl hereunto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the twentieth day of august ann Dom One thousand Seven hundred and twenty three Come again as well the said plft as the said deft by their attorneys afd and the said deft by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the plft also Att which said next Court to witt the Ninteenth day of November ann Dom one thousand seven hundred and twenty three Comes again as well the said plft as the said deft by their attorneys afd and the said deft by his said attorney prays further Leave to Imparl hereunto untill the next Court & he hath it and the same day is given to the plft also Att which said next Court to witt the seventeenth day of march ann Dom One thousand seven hundred and twenty three Come again as well the said Robert Martin by his attorney afd as the said William Shurman by his attorney afd and the said William Shurman by his said attorney as before defends the force & Injury when &c and saith that the said Robert his action afd against him the said William ^to^ have and Maintain Ought not becaus he saith altho' well and true it is that the said Willm (did) |
