157 same day and year did acknowledge himselfe to be bound unto the afd Right honourable Charles Lord Baron of Baltemore in his Life time in the afd two thousand four hundred pounds of good sound merchantable Leafe tobacco and Casque to Contain the same to be paid unto the said Right honourable Charles Lord Baron of Baltemore when he should be thereunto Required Nevertheless the afd Samuel Worthington in his Lifetime nor the afd alice whilst she was Sole Nor the afd Merick Ellis and alice his wife since the Espousalls between them Celebrated tho' often thereunto required the afd two thousand four hundred pounds of good sound merchantable Leafe tobacco and Casque to Containe the same unto the afd Right honrble Charles Lord Baron of Baltemore in his Lifetime or to the afd Margarett Lady Baltemore his Ex.rx after the deceas of the said Right honourable Charles Lord Baron of Baltemore have not Rendered but the same to her to Render have desired and the said Merick Ellis and Alice his wife the same to the said Margarett Lady Baltemore Ex.rx as afd to render still do deny and unjustly detain to the retarding her in the Execution of the Last will and testament afd Whereupon she saith she is worse and hath damage to the value of four thousand pounds of tobacco and thereof she Brings Suite and Brings into Court here the Letters Testamentary of the of the afd Right honrble Charles Lord Baron of Baltemore by which it plainly appears to the Court here the afd Margarett Lady Baltemore to be Exrx of the testament of the afd Right honrble Charles Lord Baron of Baltemore and thereupon to have administration &c Allen P Quer Pledgs dep Jno Do R Roe And the said Merick Ellis and Alice his wife Exrx as afd by Levin Gale their attorney Comes and defends the force and Injury when &c and pray Leave to Imparle hereunto untill the next Court and ^they have it^ he hath and the same day is given to the plft also Att which said next Court to witt the Eighteenth day of June ann Dom One thousand seven hundred and twenty three Come again as well the said plft as the said defts by their attorneys afd and the said defts by their said attorney pray further Leave to Imparle hereunto untill the Next Court and they have it and the same day is given to the plft also Att which said next Court to witt the twentieth day of August ann Dom one thousand seven hundred and twenty three Come againe as well the said plft as the said defts by their attorneys afd and the said defts by their said attorney pray further Leave to Imparle hereunto untill the next Court and they have it and the same day is given to the plft also Att which said next Court to witt the Ninteenth day of November ann Dom one thousand seven hundred and twenty three Come again as well the said plft as the said defts by their attorney afd and the said defts by their said attorney pray further Leave to Imparle hereunto untill the Next Court and they have it and same day is given to the plft also Att which said next Court to witt the seventeenth day of March ann Dom one thousand seven hundred & twenty three Come again as well the said Margarett Lady Baltemore Exrx as afd by their as the said Merick Ellis and alice his wife Exrx as afd by their attrney afd and the said Merick and Alice by their said attorney as before defends the force & Injury when &c and prays Oyer of the writing obligatory afd & it is Read unto them in these words vizt Maryland fs Know all men by these presents that I Samuel Worthington ^of^ Somersett County am held and firmly Bound unto the right honourable Charles Ld Baron of Baltemore in the full and Just Sum of two thousand four hundred pounds of good sound merchantable Leafe tobacco in Casque to Contain the same to be paid unto the said (Lord) |
