148 of the said Lord proprietary against the said William Robinson and not to depart the same Court without Lycence thereof &c Ordered by the Court that John Langsdale deliver unto William Stoughton Esqr or order two Cows & Calves & one Box that he hath in his Custody that was Left unto a Certain David Smith ^an orphan Boy^ by his father Late decd &c Ordered by the Court that John Disharoon Clear the road by William Cary's Plantation as he shall think fitt &c
having but being seduced and Led away by the Instigation of the devill the day of October ann Dom one thousand seven hundred and twenty three at the parish & County afd did Committ fornication ^with^ to a Certain person to this Inquest ^un^Known by reason whereof the said Rachell on day of October ann Dom seventeen hundred and twenty three at the Parish and County afd was delivered of a bastard Child against the peace &c and against the form of an act of assembly of this province Now in force in Such Case made & provided &c On the Back of the foregoeing Bill it was thus Endorst vizt Billa vera Ja Mackmorie Foreman Thereupon Command was given to the Sherr of Somersett County that he should take the afd Rachell Walton of the County afd Spinster if she should be found in his Bailiwick and he should Safe Keep so that he might have her Body Before the Justices of his Lordships County Court of Somersett to be held at Dividing Creek third tuesday of March next to answer unto his Lordship Concerning a bill of Indictm.t against her found & that thereof he should not fail &c Att which said third tuesday of March to witt the seventeenth day of the same month ann Dom one thousand seven hundred and twenty three being the day of the return of the afd Writt Cometh the Sherr of Somersett County and make the return thereof Endorst vizt Cepi Corpus P Joseph MccClester Sherr Whereupon the said Rachell Walton appears and being by the Sherr sett to the Barr is thereupon Instantly demanded how she would acquitt herselfe of the premisses afd above Imposed upon her says that of the premisses afd she is no ways Guilty thereof and submitts to the mercy of the Court & makes Oath that a Certain Solomon Yearly al.s Turpin is the Begetter of the Child she stands Indicted for but hath not wherewithall to pay her fine for the fact afd &c Wherefore it is Considered by the Justices here that the said Rachell Walton be had to the publick whiping Post and there be whipt with fifteen Lashes on the bare Back well Laid on untill the Blood appear and thereupon the said Rachell Walton is discharged she giveing security for paymt of the severall officers fees due by occasion of the premisses afd &c thereupon a Certain Jeremiah Wright present in Court undertakes for the said Rachell Walston and acknowledged himselfe to owe & stand Justly Indebted unto his Lordship in ten pounds Currt mony to be Levied &c In Case he doth not pay unto the severall Officers their Fees due upon the Indictmt afd by occasion of the premisses afd &c |
