145 Thereupon Command is given to the Sherr of Somersett County that he should take the said Edward Chapman if &c to answer &c and now hereafterwards to witt the Ninteenth day of November ann Dom one thousand seven hundred and twenty three Comes the said Edward Chapman in his own proper person and prays Leave to Imparle hereunto untill next Court to answer the premisses afd and it is granted him and the same day is given unto his Lordships attorney (who for his said Lordship in this Behalfe prosecuteth) also Att which said next Court to witt the seventeenth day of March ann Dom One thousand seven hundred and twenty three Comes againe as well his said Lordships attorney (who for his Said Lordship in this Behalfe prosecuteth) as the said Edward Chapman in his own proper person and the said Edward Chapman being sett to the bar is thereupon Instantly demanded how he would acquitt himselfe of the premisses above Imposed upon him says that of the premisses afd he is noe ways guilty thereof and for tryall thereof putts himselfe upon the County and William Tazewell his Lordships attorney who for his said Lordship in this Behalfe prosecutes says that he is Guilty & prays that it may be Enquired of by the Country Likewise Thereupon Command is given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c by whom &c who neither &c to recognize &c because as well &c of which said preceipt the said sherr to witt Joseph MccClester Gentl makes return that he has here ready twelve &c as by his preceipt he was Commanded and the Jurors of that Jury therein Impannelled who being Called Came to witt Thomas Peale Wm Handy John Dennis Sen.r Charles Cottingham, John White Marumsco, William Holland Isaac Williams James Lindow John Beavens, Lazarus Maddux Pocomoke David Hazzard, John Patrick Junr who being duly Elected tryed & sworn to say the truth in the premisses upon their Oath do say that Edward Chapman is guilty of the premisses as by the Indictm.t above is Imposed upon him &c Wherefore it is Considered by the Justices here that the said Edward Chapman be fined to his Lordship the Lord proprietor the sum of thirty Shillings for the fact afd (thereupon Mr Levin Gale paid thirty shillings for the fine afd to Mr John Caldwell on acc.t of George Greer) Whereupon the said Edward Chapman is discharged from the Indicm.t afd paying the severall Officers their Fees due by Occasion of the premises afd &c
in thirty pounds to return the said Mary Roberts to the County Court or the sherr of the County at the Expiration of her servitude &c Now hereat this day to witt the seventeenth day of March ann Dom one thousand seven hundred and twenty three Comes the said John Rickerds and Brings with him the said Mary Roberts and delivers her up to the County Court &c and forasmuch as the said Mary Roberts hath not wherewithall to pay her fine for the fact afd Wherefore It is Considered by the Justices here that the said Mary Roberts be whipt with ten Lashes at the Publick whiping Post on the Bare Back well Laid on untill the Blood appear & that she be taken &c and thereupon as to the Corporall punishm.t afd Command is given to the sherr of Somersett (County) |
