hundred and twenty two at the parish and County afd did Committ fornication with a Certain Edward Chapman by reason whereof the said Ann Whely the seventh day of aprill ann Dom seventeen hundred & twenty three at the parish and County afd was delivered of a bastard Child against the peace &c and against the form of an act of assembly of this province Now in force in such Case made & provided &c Tazewell Cler Indictmts One the back of the foregoeing Bill of Indictm.t it was thus Endorst viz.t Billa Vera Ja Mackmorie Foreman Thereupon Command was Given to the Sherr of Somersett County that he should take the said Ann Whely if &c to answer &c And now hereafterwards to witt this seventeenth day of March ann Dom one thousand seven hundred & twenty three Comes the said Ann Wheley and being by the sherr sett to the Barr is thereupon Instantly demanded how she would acquitt herselfe of the premisses afd above Imposed upon her says that of the premisses afd upon her Imposed she is guilty thereof and submitts to the Mercy of the Court and makes Oath that a Certain Edward Chapman is the begetter of the Child she stands indicted for But hath not wherewithall to pay her fine for the fact afd &c Wherefore it is Considered by the Justices here that the said Ann Wheely be whipt at the publick whiping post with twelve Lashes on the Bear Back well Laid on untill the Blood appear for the fact afd & that she be taken &c and thereupon as to the Corporall punishm.t afd Command is given to the Sherr of Somersett County that he doe thereof Immediate Execution according to the Judgmt afd Rendered by Whiping the afd Ann Whely at the publick whiping post with twelve Lashes on the bear back well Laid on untill the Blood appear and afterwards in the same Court the Sherr returns that he has done the Execution of the Judgm.t afd as to the Corporall punishm.t afd he was Commanded thereupon the said Ann Whely is discharged from the Indictm.t afd she giving security for paymt of the severall officers their fees by occasion of the premisses afd Whereupon a Certain John Perkins of Somersett County present here in Cort undertakes for the said Ann Whely and acknowledged himselfe to owe & stand Justly Indebted unto the said Lord proprietary his heirs & successors in ten pounds Currt money to be Levied &c In Case he doth not pay unto the sever^all^ officers their fees due by occasion of the premisses afd &c
One thousand seven hundred and twenty two at the parish afd in the County afd within the Jurisdiction of this Court the fear of God before his Eyes not having but being seduced and Inticed by the Instigation of the devill fornication did Committ with a Certain Ann Whely and then & there had Carnall Knowledge of her body and on the Body of the Said Ann Whely did begett a bastard Child against the form of an act of assembly of this province in such Case made & provided and against the peace &c and the good rule & Government of the Lord propry &c Tazewell Cler Indictmts On the Back of the foregoeing Bill of Indictmt it was thus Endorst vizt Billa vera Jas: Mackmorie foreman (thereupon) |
