143 the fact afd Wherefore it is Considered by the Justices here the same day & year Last Mentioned that the said Mitchell Dashiell be fined to his Lordship thirty shillings for the fact afd (which is paid by George Dashiel Genl: on acc.t of andrew Lackeys order from the County) thereupon the said Mitchell dashiell is discharged from his Recognizance paying the severall officers their fees due by occasion of the premisses afd &c
of fifteen pounds Curr.t money of this province due to be Levied on their goods & Chattles Lands or tenements for the use of his Lordship The Condition of which recognizance is such that if the above bound James Feillett do make his personall appearance before the Justices of Somersett County Court to be held at Dividing Creek the third tuesday of march to answer unto such things as shall be Laid to his Charge on behalf of his Lordship and do not depart the said Court without Leave then this recognizance to void Els to remain in full force and vertue in Law Jn.o Handy James Dashiell Att which said third tuesday of march to witt the seventeenth day ^of^ the same month ann Dom one thousand seven hundred & twenty three personally appeared here in Court the afd James Feillett and prays that his appearance may be recorded to save himselfe and securitys from the above recocognizance of Bail &c Whereupon the said James Feilletts appearance is Recorded & he and his Securitys accordingly discharged therefrom &c Thereupon it's ordered by the Court that the said James Feillett give New recognizance with two Securitys for his appearance before the Justices of assize Nisi. prius and Justices of Oyer & terminer and Goal Delivery the first tuesday of aprill next to answer unto all such matters and things as shall be then & there objected against him on his Lordships Behalfe & unto stand & abide the Judgmt of the Court thereupon & Not for to depart the same Court without Lycence thereof &c But for want thereof the said James Feillett is Committed into the Custody of the Sherr of Somersett County thereto remain &c the said Sherr being Present took Charge of the Said James Feillett accordingly &c
Acknowledged himselfe to owe & stand Justly Indebted unto his Lordship the right honourable the Lord proprietary of this province of maryland his heirs and successors in the sum of fifty pounds Currt money to be Levied on his Body Goods or Chattels Lands or tenements for the use of his said Lordship; In case he do not (make) |
