be free after his death only that your petitioner to serve his heirs or assignes till twenty one years of age which your petitioner did truely and was sett free Now may it please your worships since I have been free by Some Instrument in Writing I have Engaged my selfe to a Certain M.rs Hannah Horsey at Back Creek as she says for her Lifetime she the said M.rs Horsey finding me in sufficient meat drink & Cloathing w.ch she does not but says she will give me but what she pleases and am threatned to be shall sold with my Child now that your worships would be pleased to take it into Consideration and Caus the said M.rs Horsey to produce the said Writing that your Worships may Know by what she holds me and my Child and grant me some releife for I am threatned by her son John Horsey to be shott sometimes as your Worships in your wisdome shall seem meet and as in duty Bound your Worships poor petitioner shall Ever pray Bess Negro Thereupon Command was given to the Sherr of Somersett County that he should sommon the said Hannah Horsey & John Horsey if they should be found in his Bailywick that all Excuses sett apart they be and appear before the Justices of his Lordships County Court of Somersett to be held at Dividing Creek the third tuesday of March then Next and that they have there the said Indenture by Which the said negro Bess is held to answer the petition afd & that thereof he should not fail &c Att which said next Court to witt the seventeenth day of march ann Dom one thousand seven hundred and twenty three being the day of the return of the said Writt Cometh the Sherr of Somersett County and maketh return thereof to the Court here Endorst in these words following vizt sumsd P me Jos MccClester Sherr Whereupon the said Hannah Horsey & John Horsey in their own proper persons appears herein Court as also the said Petitioner and the Petition afd being read & heard and the severall allegations on both parts as well on the part of the said Horseys as on the part of the said Petitioner and Likewise the said Indenture by Which the afd Petitioner is said to be held being Inspected by the Court and All and Singular the premises Considered &c
