1723 135 for the whole firmly by these presents seall'd with our seals & dated ye 20.th day of Nov.r ann Dom 1723 The Condition of the above obligation is such that whereas the Commisary Generall hath transmitted into this Court ye account of the Estate of Mary Stevens decd wherein it is found that there is Ballance due to the abovesaid Orphans the sum of twenty four pounds fifteen shillings and ten pence if therefore the said Lazarus Maddux his heirs Exrs or adm.rs doe & shall well & truly pay and satisfie unto the sid orphans the sum of Eight pounds five shillings & three pence Each when they shall attain to full years according to act of assembly now in force &c then the above obligation to be void & of None Effect Else to remain in full force and vertue Lazarus Maddux (seal) Signed Sealed & Delivered in the presence of us Alexd Maddux (seal) W.m Taylor, Thomas Hayward Somersett County fs: Know all men by these presents that Wee Robert Wair and Southy Whittington of Somersett County in the province of maryland Gentl: are holden & firmly Bound unto Sarah Kirke in the full & Just Sum of One hundred and twenty Eight pounds twelve shillings Curr.t money to be paid unto the said Sarah Kirke her heirs Executors adm.rs or assignes to the which paym.t well & truely to be made wee bind us and Every of us Our and Every of Our heirs Executors & adm.rs Joyntly & Severally in & for the whole firmly by these presents sealed with our Sealls & Dated the twentieth day of Nov.r ann Dom: 1723 The Condition of the above Obligation is such that whereas the Commissary Generall hath transmitted unto this Court ye accompt of the Estate of John Kirke dec.d wherein it is found that there is Ballance due to the above said Orphans the sum of sixty four pound sand six shillings if therefore the said Robert Wair his Executors or adm.rs doe and shall well & truely pay & satisfie unto the said orphan the afd sixty four pounds six shill.s when he shall attain to full years according to act of assembly Now in force &c then the above Obligation to be void Else to remain in full force & vertue Robert Wair (seal) Signed Sealed & Delivered in presence of us Southy Whittington (seall) Thomas Hayward, William Taylor Whereas there was formerly an Order of Court made for the Clearing a road from Costuns dam at the head of Dividing Creek to M.r John Scotts Landing On pocomoke &c Now hereat to witt this twentieth day of August Ann DOm One thousand seven hundred and Twenty three personally appeared herein Court a Certain Steven Coston and Avers to the Court here that the afsd Road Runs through his plantation and is Very Prejudiciall to the same &c Whereupon it is Considered & Ordered by the Court here that Maj.r Charles Ballard Capt John Jones and William Stoughton Esq.r appoint a Convenient time and Meet On ye sd Road and Inspect the same and make their Report thereof at next Court &c On ye Back of the Fore Going Order it was Thus Indorst Viz.t In Submission to the within Order Wee the Subscribers On the seventh day of September Last Mett On the within Mentioned Road and haveing Viewed the same doe think it Proper that the said Road Remains unaltered according to the within Limitation &c and that the same Road Doth not Appear to us to be of Prejudice to the said Stephen Costin as within he hath Suggested &c Charles Ballard William Stoughton |
