125 by the Justices here the Ninteenth day of November ann Dom One thousand seven hundred and twenty three that the said sum of One hundred and sixty pounds of tobacco so as afd attached be Condemned in the hands of the said Hugh Porter as of the rights and Creditts of the said Robert Pitts towards satisfying unto the said Thomas Drummond and Mary his wife adm.rx as afd as well the sum of two thousand two hundred pounds of tobacco their debt afd as also the Costs accrueing upon the writt of attachm.t afd and that the said Thomas Drumond & Mary his wife have thereof their Execution against the said Hugh Porter according to act of assembly &c
Sherr of Somersett County Greeting we Command you that you attach any the goods and Chattels rights Creditt of King Poole late of somersett parish in Somersett County al.s dictus King Pool of Somersett County and province of maryland planter if they shall be found in your Bailywick to the value of Eighteen hundred pounds of tobacco and when you have the same attached or any part thereof the same in your Custody Safe Keep so that you have the same Before the Justices of our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of November next then & there to be Condemned according to act of assembly to and for the use of a Certain Thomas Dashiell unless the said King Pool by himselfe or his attorney appear and answer unto the said Thomas Dashiell in a plea that he render unto him Nine hundred pounds of tobacco which to him he Owes and from him he unjustly detains &c according to Law and that by good and Lawfull men of your Bailiwick you make Known unto the person or persons in whose hands you make the same attachm.t that he she or they be and appear before the Justices of Our Said Court to be held as afd to shew Cause if any he she or they have why the same goods Chattles Rights or Creditts so attached in his her or their hands ought not to be Condemned and Execution thereof had and made according to the form of the act of assembly in that Case made and provided if to him her or them it shall seem mete and how you shall Execute this writt that you make Known unto Our said Justices at the day & place afd and have you then & there this writt Wittness Charles Ballard Gentl: Chief Justice of our said Court ye 24.th day of aug.t in ye Eighth Year of Our Dominion &c ann Dom 1723 (G Dashiell) Thomas Hayward Clk Att which said third tuesday of November to witt the Ninteenth day of the same month ann Dom one thousand seven hundred and twenty three being the day of the return of the said Writt Cometh the said Thomas Dashiell by George Dashiell his attorney and the Sherr of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorst in these words following viz.t To the worshipfull Justices within Mentioned I humbly Certifie that by vertue of (the) |
