you that you attach any the goods Chattells rights or Creditts of Robert Pitts of Coventry parish in the County afd Cooper al.s dictus Robert Pitts in the County afd if they shall be found in your Bailywick to the value of two thousand two hundred pounds of tobacco and when you have the same attached or any part thereof the same in your Custody Safe Keep so that you have the same Before the Justices of Our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of november next then and there to be Condemned according to act of assembly to and for the use of a Certain Thomas Drummond and Mary his wife adm.x of John Griffith dec.d unless the said Robert Pitts by himselfe or his attorney appear and answer unto the said Thomas Drummond and Mary his wife adm.x as afd in a plea that he render unto them fifteen hundred pounds of tobacco which from them he unjustly detains &c according to ^Law^ act of assembly & that by good and Lawfull men of your Bailywick you make Known unto the person or persons in whose hands you make the same attachm.t that he she or they be and appear before the Justices of Our Said Court to be held as afd to shew Cause if any he she or they have why the same goods Chattels rights or Creditts so attached in his her or their hands Ought not to be Condemned and Execution thereof had & made according to act of assembly in that Case made and provided if to him her or them it shall seem mete and how you shall Execute this writt that you make Known unto Our Said Justices at the day and place afd and have you then & there this Writt Wittness Charles Ballard Gentl Chief Justice of Our Said Court the 24.th day of august in the Eighth year of Our Dominion &c Ann Dom 1723 (L Gale) Thomas Hayward Clk Att which said third tuesday of November to witt the Ninteenth day of November ^the^ same month ann Dom One thousand seven hundred and twenty three being the day of the return of the said Writt Come the said Thomas Drummond and Mary his wife ^adm.x as afd^ by Levin Gale their attorney and the sherr of Somersett County to whom the foregoeing writt was directed Likewise Comes and makes return thereof to the Court here Endorst in these words following viz.t To the worshipfull Justices within mentioned I humbly Certifie that by vertue of the within Writt to me directed I have attached in the hands of Hugh Porter the sum of One hundred and sixty pounds of tobacco as the Rights and Creditts of the within Named Thomas the said ^Robert Pitts^ and I further Certifie that I have Given Notice unto the said Hugh Porter that he be & appear at the time & place within Contained to shew Cause &c Before Matt Hopkins and John ^Doe^ good and Lawfull men of my Bailywick as by the within writt I am Commanded so answers Jos: MccClester Sherr Whereupon the said Hugh Porter Garnishee as afd altho' solemnly Called to shew Cause why &c Comes not but makes default nor does any other person appear for him to shew Cause to the Contrary &c Whereupon the said Thomas Drummond and Mary his wife adm.rx as afd by their attorney afd prays that the sume of One hundred & sixty pounds of tobacco afd so as afd attached in the hands of the said Hugh Porter as of the rights and Creditts of the said Robert Pitts may be Condemned in the hands of the said Hugh Porter towards satisfying unto the said Thomas Drummond & Mary his wife adm.x as afd as well the sum of two thousand two hundred pds of tobacco the debt afd as also all Costs accrueing upon the writt of attachm.t afd Therefore it is Considered (by) |
