125 the within Writt to me directed to the Justices I have attached in the hands of John SCott the sum of Eighteen hundred pounds of tobacco as the rights and Creditts of King Poole and I further Certifie that I have Given Notice unto the said John Scott that he be and appear at the time & place within Contained to shew Cause &c before Hugh Porter & John Doe Good & Lawfull men of my Bailiwick as by the within writt I am Commanded so answers Jos: MccClester Sherr Whereupon the said John Scott Garnishee of the afd King Poole appears in his own proper person and says that he Cannot Gainsay but that he has of the rights and Creditts of the said King Poole (that is to say) a feather Bed nor Can he say but that the same Ought to be Condemned in his hands for the use of the said Thomas Dashiell as of the rights and Creditts of the said King Pool which the said plft does not gainsay Whereupon the said Thomas Dashiell by his attorney afd prays that the feather Bedd afd upon giveing security according to act of assembly so as afd Confessed by the said John Scott as of the rights & Creditts of the said King Poole may be Condemned in the hand of the said John Scott towards satisfying unto the said Thomas Dashiell his debt afd as also all Costs accruing upon the Writt of attachm.t afd &c Thereupon Levin Gale of Somersett County Gentl: Present here in Court make undertakes for the said Thomas Dashiell according to act of assembly that in Case the said King Poole do at anytime within a year and a day appear and make all or any part of the Claim of the said Thomas Dashiell against him appear to be satisfied or otherwise to have Been undue before the Laying of this attachm.t that then the said Thomas Dashiell shall make restitution unto the said King Pool of all or such part as shall be made appear to be undue &c or that he the said Levin Gale will do it for him Therefore it is Considered by the Justices here the Ninteenth day of November ann Dom one thousand seven hundred and twenty three that the feather Bed afd so as afd Confessed be Condemned in the hands of the said John Scott as of the rights and Creditts of the said King Poole towards satisfying unto the said Thomas Dashiell as well the sum of Eighteen hundred pounds of tobacco as also the Costs accrueing upon the writt of attachmt afd and that the said Thomas Dashiell have his Execution thereof against the said John Scott according to act of assembly
the sherr of Somersett County Greeting We Command you that you attach any the Goods Chattles rights or Creditts of Robert Perry Late of allhollows parish in the County of Somersett planter if they shall be found in your Bailywick to the value of twelve hundred pounds of tobacco and when you have the same attached or any part thereof the same in your Custody Safe Keep so that you have the same Before the Justices of Our County Court to be held at Dividing Creek in Somersett County afd the third tuesday of November next then and there to be Condemned according to act of assembly to and for the use of a Certain Thomas Dashiell unless the said Robert Perrie by himselfe or his attorney appear and answer unto the said Thomas Dashiell in a plea of trespass upon the Case &c according to law and that by Good and Lawfull men of your Bailywick you make Known unto the person (or) |
