November Court
1723 122 Gurley to answer &c and the said George Gurley being sett to the Barr is thereupon Instantly demanded how he would acquitt himselfe of the premisses afd above Imposed upon him says that of the premisses afd an it is by the above Indictm.t in manner & form supposed he is noeways Guilty thereof and thereof for tryall putts himselfe upon God and his Country (and prays that Councell may be assigned him in the premisses afd thereupon from George Dashiell is appointed as Councell to act in the premisses &c) and William Tazewell who for his said Lordship the Lord proprietor in this Behalfe prosecutes says that he is Guilty and prays that it may be Enquired of by the Country Likewise thereupon Command is Given to the sherr of Somersett County that Immediately he Cause to Come here twelve &c to Recognize &c by whom &c who as well &c and the said William Tazewell who prosecuteth &c and also the said George Gurley prisoner as afd being here in Court the said Sherriffe to witt Joseph MccClester Gentl makes return that he has here ready twelve &c is by his said preceipt he was Commanded who being Called Came to witt John Roach, Henry Toadvine, Robert Collier, Thomas Hobbs, Jacob Adams, Charles Cottingham, George Benson, Stephen Horsey, Thomas Dickson, David Hazard John Dennis Sen John Records who being duely Elected tryed & sworn ^to say the truth in the premisses^ upon their Oath do say that the said George Gurley is not Guilty of the premisses as by the Indictm.t above is Imposed upon him &c Therefore it is Considered by the Justices here the Ninteenth day of November ann Dom One thousand seven hundred and twenty three that the said George Gurley goe thereof acquitt &c Whereupon it is Ordered by the Court that the said George Gurley Give Security for the paymt of the several Officers their fees due by Occasion of the premisses afd thereupon a Certain Francis Person of Somersett County present here in Court undertook for the said George Gurley to pay unto their several Officers their fees due by occasion of the premisses afd &c Whereas the Bridge that I over the head of Manocan river is so decayed that it's dangerous to ride or pass Over &c therefore it is Ordered by the Court that Coll Charles Ballard, William Stoughton Esq.r & M.r Levin Gale agree with some person or persons for the repairing of same Bridge and the Keeping it in good repair and to make there report at next Court &c Upon the Mocon of M.r Francis Allen for the haveing a free ferry Over Nanticoke river at the Town of Vianna &c Its Ordered by the Court that there be no free ferry (that is) there be noe ferry ^maintained^ Waited by the County ^of Somersett^ over any part of Nanticoke river for the future &c
bounds is rendered Precarious and their being provision made by a late Act of assembly Impowering the Justices of the County Court to appoint such persons as they shall think fitt to mete on the said Land to take the depositions of all such persons as shall be to them Named in relation to the Bounds of the said Land afd the premisses Considered and our Worships appointing such persons as to you shall seem mete in Complyance of the afd act of assembly your petitioner will Ever pray for your Worships Prosperety &c W.m Fasitt the petition afd being read and heard and the premisses Considered &c Its Ordered by the Court that Commission Issue Out of this Court according to act of assembly to Saml Hopkins, John Purnell Adam Spence sen & Robert Martin (to) |
