120 the Bare back well Laid on untill the blood appear and that she stand in the pillowry halfe a quarter of an hour and that she be taken &c And thereupon as to the Corporall punishm.t afd Command is Given to the Sherr of Somersett County that he do thereof Imediate Execution according to the Judgm.t afd rendered by whiping the afd Joseph J Mary Cavanough at the Publick whiping post with ten Lashes on the bear back well Laid on untill the Blood appear and by sitting her in the pillowry halfe a quarter of an hour and afterwards in the same Court the Sherr returns that he has done the Execution of the Judgm.t afd as to the Corporall punishm.t afd he was Commanded Thereupon It's Ordered by the Court that M.r Jos: Gray Master of the said Mary Cavanough return her to the County Court ofor Sherr of the County at the Expiration of her servitude to reemburst ^to^ the County the four fold afd & all the Officers fees that accrued by occasion of the premisses afd &c Likewise Command is given to the sherr of Somersett County that he should take the said Sarah Walker Sen.r Sarah Walker Jun.r Susannah Walker and Mary Walker if &c to answer &c and afterwards to witt the seventeenth day of November being the same day Came the said Sarah Walker Sen Sarah Walker Jun Susannah Walker and Mary Walker in Custody of the said Sherr & being by the said Sherr sett to the Barr (Indictm.t read) is thereupon Instantly how they would acquitt themselves of the premisses afd above Imposed upon them say that of the premisses afd as it is by the above Indictm.t in manner and form Supposed against them they are in noe wise Guilty thereof and thereof for tryall putt themselves upon God and their Country [and prays that Councell may be assigned them in the premisses afd ^thereupon Francis Allen is appointed as Councell to act in the premisses^ &c] and the William Tazewell who for his said Lordship the Lord proprietary in this behalfe prosecuted says that they are Guilty and prays that it may be Enquired of by the Country Likewise Command is therefore Given to the Sherr of Somersett County that Immediately he Cause to Come here twelve &c to recognize &c by whom &c who as well &c and also the said Sarah Walker Sen Sarah Walker Jun Susannah Walker & Mary Walker Prisoners as afd being here in court the Sherr to witt Joseph MccClester Gentl: makes return of his said Writt that he hath here ready twelve &c as by his preceipt he was Commanded who being Called Came to witt John Roach Henry Toadvine Robert Collier Jacob Adams Charles Cottingham George Benson Thomas Dickson ^David Hazard^ John Dennis Sen John Records Edward Round Charles Ratcliffe who being duly Elected tryed and sworn to say the truth in the premisses upon their Oath doe say that the said Sarah Walker Sen Sarah Walker Jun Susannah Walker and Mary Walker are not Guilty of the premisses as by the above Indictm.t is Imposed upon them therefore it is Considered by the Justices here the same day and year that the said Sarah Walker Sen Sarah Walker Jun Susannah Walker and Mary Walker goe thereof acquitt &c further it is Ordered by the Court that the said Sarah Walker Sen Sarah Walker Jun Susannah Walker and Mary Walker Give New recognizance with two Securitys Each in fifty pounds Each for to stand and abide the Judgm.t of this Court and not to depart the same Court without Lycence thereof Thereupon Thomas Walker and Lazarus Maddux of Somersett County present herein Court acknowledged them selves to Owe and Stand Justly Indebted unto his Lordship the right (honrble) |
