120 value of Eight shillings Curr.t money of maryland one switch Cloath apron of the value of six shillings Like money as afd one pair of Cotten stockins of the value of Eight shillings like money as afd and one Cambrick Mobb: of the value of three shillings Like money as afd of the Goods and Chattles of a Certain Merrick Ellis and one pair of Cotton stockings of the value of seven shillings Like money as afd and two Muslaine Stocks of the value of four shillings of the Like money afd of the goods and Chattles of ^a Certain^ John Bannister then and there being found then and there feloniously took stole & Caried away against the peace &c and the good rule and dignity of the right honourable the Lord Proprietary &c and against the form of an act of assembly of this province in such Case made and provided &c And that Sarah Walker Sen.r wife of a Certain Thomas Walker Late of Stepney parish in ye County afd planter Sarah Walker Jun.r Late of Stepney parish and County afd Spinster, Susannah Walker Late of the County and parish afd Spinster and Mary Walker Late of the ^parish &^ County afd Spinster Knowing the afd Mary Cavanough the felony afd at the Parish and County afd in manner and form afd to have done and perpetrated Nevertheless the afd Sarah Sen.r Sarah Jun.r Susannah and Mary at Stepney parish afd in the County afd within the afd Jurisdiction the twenty fourth day of may in the year abovesaid feloniously after the felony afd so as afd by the afd Mary Cavanough done and Committed received and Comforted the said Mary Cavanough with the goods and Chattles so as afd feloniously stolen against ye peace &c and the good rule and dignity of the right honourable the Lord proprietary &c and against the form of an act of assembly of this province in such Case made & provided Tazewell Clk Indictmts Testes Merrick Ellis Etuxor, Thomas Holbrook Etuxor Ann Shiles, Ann Wilkins, Eliz.a Hust, John Records John Bannister, Jno Carr On the Back of the foregoeing Bill of Indictm.t it was thus Endorst Billa Vera Ja: Mackmorce foreman Thereupon Command is Given to the Sherriffe of Sommersett County that he Should take the said Mary Cavanough if &c to answer and afterwards to witt this seventeenth day of November ann Dom One thousand seven hundred and twenty three being the same day Comes the Said Mary Cavanough in Custody of the said Sherr into whose Custody before that time was Committed for the Cause afd and the said Mary Cavanough being by the Sher sett to the Barr (Indictmt read) is thereupon Instantly demanded how she would acquitt herselfe of the premisses afd above Imposed upon her says that of the Premisses afd as it is by the above Indictm.t in manner and form Supposed against her she is Guilty thereof and submitts herselfe to the Mercy of the Court wherefore the Court here valued the Goods in ye Indictm.t afd mentioned to be stolen to thirty six shillings Therefore it is Considered by the Justices here the same day & year that the said Mary Cavano^u^gh pay unto Merrick Ellis and John Bannister the partys deprived four fold of the value of the Goods afd mentioned to be stolen amounting in the whole to seven pounds four shillings and that the said Mary Cavanough be whipt with ten Lashes on (the) |
