12 Att which said third tuesday of march to witt the Nineteenth day of the same month being ann Dom one thousand seven hundred and twenty two being the Day of the return of the said Writt Come the said John Scarbrough by his attorney afd and the Sherr of Sommersett County to whom the foregoeing writt was directed Likewise Comes and makes return thereof to ye Court here Endorst in these words following vizt Non Est P Jos: M.ccChester Sherr Whereupon the said John Scarbrough by his attorney afd Prays that for as much as he has Comply'd with the Laws in Order for an attachm.t he may have Judgm.t against the said William Gilchrist for his damages afd by way of an attachm.t according to act of assembly &.c Whereupon for that it saves to the Court here that ye said John Scarbrough has Complyed with the Laws as alledged Therefore it is Considered by the Justices here the Nineteenth day of march Ann Dom One thousand seven hundred and twenty two afd that the said John Scarbrough recover against ye said William Gilchrist as well the sum of two pounds seven shillings and six pence his damages by Occasion of the premises afd as all Costs and Charges by the said plft laid Out and Expended about his suite by way of attachm.t against the good Chattles rights or Creditts of the said William Gilchrist according to act of assembly in such Case made and provided &.c
to answer unto Thomas Holdbruck of a plea of trespass upon the Case &.a and that thereof he should not fail &.c Att which said third tuesday of march to with the Nineteenth day of the same Month ann Dom One thousand seven hundred and twenty two Being the day of the return of the said Writt Comes the said Thomas Holbruck by George Dashiell his attorney and the Sherr of Sommersett County to whom the foregoeing writt was directed Likewise Comes and makes return thereof to the Court here Endorst in these words following vizt Cepy P Jos: MccChester Sherr Whereupon the said George Godman by francis Allen his attorney Comes and defends the force and Injury when &.c and Offers himselfe against the said Thomas Holbruck in the Plea afd but the said Thomas Holbruck altho' solemnly Called Comes not nor is his writt in the Plea afd further prosecuted against the said George Godman Therefore it is Considered by the Justices here the same day and Year Last mentioned that the said Thomas Holbrook and his Pledges in Prosecuting be in mercy &.c and lett the Names of the said Pledges be sought for &.c and that the said George Godman goe thereof without day And also it is Considered by the Justices here that ye said George Godman recover against the said Tho.s Cost (158) Holbruck the sum of one hundred & fifty Eight pounds of tob.o by the Court here adjudged unto him for his Costs and Charges by him about his defense in this Behalfe Laid Out & Expended according to ye forms of the statute &c |
