March Cort 1722 Margarett Lady Baltemore Ex.x of the right honrble Charles Lord Baron of Baltemore decd by her attorney afd and the Sherr of Somrsett County to whom the foregoeing writt was directed Likewise Comes and makes return thereof to the Court here Endorst in these words following viz.t Non Est Jos: M.ccChester Sherr Whereupon the said Margarett Lady Baltemore Exrx as afd by her attorney ^afd^ Prays that for as much as she has Complyed with the Law in Order to an attachm.t She may have Judgm.t against the said William Layton son and heir as afd for her debt afd by way of attachm.t according to act of assembly &ca Whereupon for that it seems to the Court here that the said Margarett Lady Baltemore Exrx as afd has Complyed with the Law as alledged Therefore it is Considered by the Justices here the Nineteenth day of march Ann Dom One thousand Seven hundred and twenty two that the said Margarett Lady Baltemore Exrx as afd Recover against the said William Layton Son and heir as afd as well the sum of six thousand pounds of tobo her debt afd as all Costs and Charges by the Said Plft Laid out and Expended about her suite by way of attachm.t against ye goods Chattles rights or Creditts of the said William Layton son and heir as afd according to act of assembly in such Cases made and Provided &.c
should not faile &.c And whereupon the said John P George Dashiell his attorney Complains that whereas the said William the twenty sixth day of February One thousand seven hundred and twenty one One two at the Parish and County afd within the Jurisdiction of this Court was Indebted to the said John two pounds seven shillings and six pence as P.r acco.t hereunto annexed may in Court appear and being so thereof Indebted the said William in Consideration thereof the day and year afd at the Place afd upon himselfe did assume and to the said John then and there did faithfully Promise that he the said William the said two pounds seven shillings and six pence to the said John When he should be thereunto requested he would well and faithfully Content and pay Nevertheless the said Willm tho' often thereunto requested the said two pounds seven shillings and six pence to the said John hath not paid but the same to him hitherto to pay hath denyed and still doth refuse and deny whereupon he saith he is worse and hath damage to the Value of four pounds fifteen shillings and thereupon he Brings Suite Dashiell P Qte pledges Jno Do Richd Roe
