116 a Copy of the foregoing Caus of action was made and sent to be Left at the Last place of abode of the afd deft Att which said third tuesday of August C to witt the twentieth day of the Same Month ann.o Dom One thousand seven hundred and twenty three Being the day of the return of the said Writt Cometh the said Thomas Dashiell by his attorney afd and the sherr of Somersett County to whom the foregoeing Writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed in these words following viz.t Non Est Inventus short note Left P me Jos: MccClester Sherr Whereupon the said Thomas Dashiell by his attorney afd Prays that for as much as he hath Complyed with the Laws in Order to an attachm.t he may have Judgmt against the said King Poole for his debt afd by way of attachm.t according to act of assembly &c where upon for that it seems to the Court here that the said Tho.s Dashiell hath Complyed with the Law as alledged therefore it is Considered by the Justices here the twentieth day of August anno Dom one thousand seven hundred and twenty three afd that the said Thomas Dashiell Recover against the said King Poole as well the sume of Nine hundred pounds of tobacco his debt afd as all Costs and damages by the said plft Laid Out and Expended about his Suite by way of attachm.t against the goods Chattles Rights or Creditts of the said King Poole according to act of assembly in Such Case made and provided &c
attached or any part thereof the same in your Custody Safe Keep so that you have the same before the Justices of Our County Court to be held at Dividing Creek the third tuesday of august next to satisfie unto Edmond Crapper as well the sume of fifteen pounds seventeen shillings and ten pence a Certain debt due & recovered by the said Samuel Daffey and recovered against him before the Justices of Our said Court on the 19.th day of aprill 1722 whereof he is Convict as the sume of four hundred pounds of tobacco Costs of Suite together with all such Costs as ^by^ the said Shall arrive upon this Our writt of attachmt and that by good and Lawfull men of your Bailywick you make Known unto the person or persons in whose hands you make the same attachm.t that he She or they be and appear before the Justices of Our Said Court at the day and place afd to Shew Cause if any he she or they have why the same goods Chattles Rights or Creditts so attached should not be Condemned according to Law in his her or their hands for and towards satisfying of the and Costs above specifyed and how you shall Execute this writt that you make Known unto Our said Justices at the same day and place hereof fail not at your perill and have you then and there this Writt Wittness Charles Ballard Gent Chief Justice of Our said Court this 3.d day of July and in the seventh Year of Our Dominion ann Dom 1722 Alex.d Hall Clk Att which said third tuesday of August to witt the day of the same month ann Dom: One thousand seven hundred and twenty two being the day of the return of the said Writt Cometh the said Edm.d (Crapper) |
