116 to the same Charles (altho' the same Robert afterwards that is to say the tenth day of may One thousand seven hundred and twenty three at the parish afd within the af Jurisdiction was thereunto requested) hath not paid or the same Charles in any wise for it Contented but the Same Robert the same to the said Charles hitherto to pay or in any wise to Content hath altogether Refused and still doth refuse whereby the same Charles says he is the worse and hath damage to the value of three pounds ten shillings Curr.t money as afd and thereof he Brings this Site & L Gale P Quer pledged &c Jno Doe Richd Att which said third tuesday of august to witt the twentieth day of the same month ann Dom one thousand seven hundred and twenty three Being the day of the return of the said Writt Cometh the said Charles Ramsey by his attorney afd and the sherr of Sommersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorst in these words following viz.t Non Est Inventus P Jos: MccClester Sherr Whereupon the said Charles Ramsey by his attorney afd prays that forasmuch as he has Complyed with the Law in Order to an attachm.t he may have Judgmt against the said Robert Perry for his damages afd by way of attachm.t according to act of assembly Whereupom for that it seems to ye Court here that the said Charles Ramsey has Complyed with the Law as alledged Therefore it is Considered by the Justices here the twentieth day of August ann Dom One thousand seven hundred and twenty three afd that the said Charles Ramsey recover against the said Robert Perry as well the sume of thirty five shillings Curr.t money afd his damages by Occasion of the premisses afd as all Costs and Charges by the said plft Laid Out and Expended about his suite by way of attachm.t against the Goods Chattles Rights or Creditts of the said Robert Perry according to act of assembly in such Case made and Provided &c
Lordships County Court of Somersett to be held at dividing Creek the third tuesday of August ^then^ next to answer unto Thomas Dashiell of a plea that he render unto him the full and Just Sum of Nine hundred pounds of tobacco which to him he Ows and from him unjustly detains &c and that thereof he should not faile And the said Thomas Dashiell by George Dashiell his attorney sett forth the Caus of action against the said King Poole in the plea afd as followeth viz.t Somersett County fs.t King Poole Except you or your attorney appear the next august Court to be held at Dividing Creek the third tuesday thereof to answer to Thomas Dashiell of a plea of Debt on Bond for Nine hundred pounds of tobacco attachm.t will Goe against your goods if any to be found in Somersett County G Dashiell (A) |
