So: County fs:  Eward Ricketts of Stepney parish in Somersett County Planter was attached to

answer unto Henry Toadvine of a plea of trespass upon the Case &c
                               And whereupon the said Henry P George Dashiell his attorney Complaines that whereas the said
       Edward in the Year of Our Lord God One thousand seven hundred and twenty at ye Parish and County afd within
       the Jurisdiction of this Court was Indebted unto him the sum of two thousand two hundred pounds tobacco or
       twenty two Barrells of of Indian Corn as P acco.t here unto annext may in Court appear and the said Edward
       Being Indebted as afd for and In consideration afd at the time and place afd within the afd Jurisdiction did upon
       himselfe assume and to the said Henry then and there did faithfully promise that the said two thousand two
       hundred pounds of tobacco or twenty two Barr.lls of Indian Corn he would well and truely pay and Content and
       altho' six hundred pounds of tobacco Percell of the said debt he hath paid and satisfyed Yett as to the
       residue being sixteen hundred pounds tobacco or sixteen Barr.ls of Indian Corn tho' Often thereunto
       requested according to the promise and assumption afd in form afd made Little regarding but plotting &
       Contriveing him the said Henry in that part Craftily and Subtilly to deceive and defraud the said Edward
       the afd sixteen hundred pounds of tobacco or sixteen Barrells of Corne to the said Henry he hath not paid
       nor in anywise Contented but the same hitherto to pay hath denyed and still doth deny to the damage of
       the said Henry three thousand three ^two^ hundred pounds of tobo or thirty Two Barr.ls of Indian Corn and
       thereupon he Brings Suite &c    G Dashiell P Quer Pledgs Jno Doe R Roe

And the said Edward Ricketts by Francis Allen his attorney Comes and defends the force and Injury when &c
and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is Given to the
plft also
                                     Att which said next Court to witt the twentieth day of August ann Dom One thousand
seven hundred and twenty three Comes again as well the said plft by his attorney afd as the sid deft in
his Own proper person and the said deft prays ^says^ that the said he Cannot gainsay the plft his action afd
against him Brought nor Can he Say but that the said plft Ought to recover his damages by Occasion of
the premises afd to twelve Barr.ll of Indian Corn and Costs of Suite against him which the said plft does
not gainsay &c       therefore it is Considered by the Justices here the twentieth day of august ann
Dom One thousand seven hundred and twenty three afd that the said Henry Toadvine recover against
the said Edward Ricketts as well the sume of twelve hundred Barr.lls of Indian Corn Certain damages
