114 afterwards thereunto requested she would well and faithfully pay and Content Nevertheless the said ann her promise and assumption afd in form afd made Little regarding but plotting and fraudulently Intending the said Timothy in that part Craftilly and subtily to deceive and defraud the afd two pounds Ninteen Shillings and Eleven pence to the said Timothy she hath not paid or in anywise Contented altho' the same to doe the said Ann hath been thereunto often requested but the same to him to pay or in anywise to Content hath refused and still doth refuse and deny whereupon the said Timothy saith he is worse and hath damage to the value value of five pounds Ninteen shillings and ten pence and thereupon he Brings Suite George Dashiell P Qrte Pledgs Jno Doe R Roe
And the said Ann Shiles by Levin Gale her attorney Comes and defends the force and Injury when &c and prays Leave to Imparle here unto untill the next Court and she hath it and it and the same day is Given to the plft also Att which said next Court to witt the twentieth day of august ann.o Dom One thousand seven hundred and twenty three Comes again as well the said Timothy Adkeson as the said ann Shiles by their attorneys afd and same attorney of the said ann Shiles saith that he is not informed by his Clyant of any answer for her in the plea afd to the afd Plft to be given and Nothing Else thereof says whereby the same plft remains against the said deft thereof undefended. But Becaus it is not Known what damages the said Timothy Adkeson hath sustained by occasion of these premisses afd Thereupon the Justices here according to act of assembly at the prayer of the said Timothy and by the Consent of the said Ann according to act of assembly to asses the damages of the said Timothy by Occasion of ^the^ Premisses afd the same Justices here say that the said Timothy Adkeson hath sustained noe damages by occasion of the same premisses &c Therefore it is Considered by the Justices here the same day and Year Last mentioned that the said Timothy Adkeson take Nothing by his writt afd but be in mercy for his falce Clamour and that the said Ann Shiles Goe thereof without day &c and also it is Considered by the Justices here that the said ann Shiles recover ag.t the said Timothy Adkeson the sume of seven hundred & Eighteen pounds of tobacco by the Court here adjudged unto her for her Costs and da Charges by her about her defence in this behalfe Laid Out and Expended according to the form of the statute th in such Case Lately made and provided and that the said ann Shiles have thereof her Exn |
