       August Court                1723             113
John's above Originall Writt and it is read unto him in these words viz.t Somersett County fs.t Charles absolute Lord &
proprietarie of the provinces of maryland and avalon Lord Baron of Baltemore &c  To the Sherr of Somersett County Greeting
wee Command you that you take William Mathews Sen.r late of all hollows County Parish in the County afd planter if he
shall be found in your Bailiwick and him safe Keep so that you have his Body Before the Justices of our County Court to
be held at dividing Creek in Somersett County afd the third tuesday of June next to answer unto John Williams of  a plea
of trespass upon the Case &c  hereof fail not at your perill and have you then and there this writt Wittness Charles Ballard
Gent Chief Justice of our said Court the third day of may in the Eighth year of Our Dominion &c  ann Dom One thousand
seven hundred and twenty three &c which being read and heard the said William prays Judgm.t of the writt afd
because he saith that at the day of the Impetration of the writt afd was commorant and residing at Coventry Parish
in the County afd as by the Writt afd is supposed and this he is ready to verife whereupon he prays Judgm.t of that writt
and that the said Writt may be quashed &c    F Allen P Defte

                Whereupon the said John Williamson altho Solemnly Called Comes not nor is his writt in the plea afd
further prosecuted against the said William Mathews &c

                      Therefore it is Considered by the Justices here the twentieth day of august ann Dom One
thousand seven hundred and twenty three that the said John Williamson and his pledges of Prosecuting be in Mercy
&c and Lett the Names of his said Pledges be sought for &c and that the said William Mathews goe thereof w.thout
day &c And also it is Considered by the same Justices here that the said William Mathews recover against the said
(188)   John Williamson the sume of One hundred & Eighty                                                       pounds of tobacco
by the Court here adjudged unto him for his Costs and Charges by him about his suite defence in this Behalfe Laid Out
and Expended according to the form of the statute in such Case Lately made and provided and that the said
William Mathews have thereof his Ex.n &c

Sommersett County fs:  Isaac Noble late of Stepney Parish in the afd County planter was
all acted to answer unto robert Martin of a plea of trespass upon the Case &c
And where upon the same Robert by William Tazewell his attorney Complains that whereas
                the afd Isaac the twentieth day of march Ann Dom seventeen hundred and twenty two at Stepney parish
in ye County afd within the Jurisdiction of this Court was Indebted unto the afd Robert in the quantity of twelve hundred
and Eight pounds of tobacco for Sherriffs dues as by an account thereof herewith into Court brought may appear
and Being so thereof Indebted he the same Isaac in Consideration thereof upon himselfe assumed and to the same
Robert then and there faithfully promised that he the same Isaac the afd twelve hundred and Eight pounds of
tobacco unto the same robert when he should be afterwards thereto required would well and truly Content and pay
Nevertheless the afd Isaac his promise and assumption afd made Little regarding but minding and fraudulently
Intending in the afd Robert in this part Craftily and subtily to deceive and defraud the afd twelve hundred &
Eight pounds of tobacco or any part thereof unto the afd Robert altho' the same Isaac by the same Robert at
Stepney parish afd in the County afd within the afd Jurisdiction the two and twentieth day of march ann Dom
one seventeen hundred and twenty two hath been required hath not paid but the same to him pay hath
refused and still doth refuse to ye Damage of the said robert two thousand four hundred and sixteen
